Source: Volume 13, Number 01, Fall 2011 , pp.11-14(4) next article > |return to table of contents Abstract: Student handbooks have been viewed as contractual agreements in a number of court cases; for this reason many institutions now include the disclaimer that student handbooks are not contracts between students and institutions and that institutions reserve the right to amend their student handbook as they see fit. A binding contract, defined by Dennis Gregory (2010) is “an agreement between two or more competent parties.” Additionally, a binding contract is one that can be upheld by the law. The cases discussed in this article all address issues of student handbooks as contracts and court cases dealing with the legal issue of breach of contract. Keywords: disclaimer; Millien v.
