Revocable Living Trust: A Trust which is operative during the life of the Trustor (the person creating the Trust) in which he or she has complete control and disposition over his or her assets within in the Trust. A Revocable Living Trust (“RLT”) may be amended or terminated at anytime by the Trustor. A RLT holding the assets of the Trustor will avoid Probate and provide efficient management, distribution and privacy to the Estate at the death of the Trustor. Married individuals can also use RLT’s to significantly diminish or even eliminate Estate Taxes. Will: An instrument by which a Testator (the individual making the Will) makes a disposition of his or her real and personal property, to take effect after death. When a person passes away his or her Will must be admitted to Probate and the Estate’s assets are administered and distributed. The execution of Wills are governed by strict formalities, and if not followed may defeat the Testator’s wishes. Living Will: A document which governs the withholding or withdrawal of life-sustaining treatment from an individual in the event of an incurable or irreversible condition that will cause death within a relatively short time, and when such person is no longer able to make decisions regarding his or her medical treatment.
