CRIMINAL CASE RESULTS
CHARGE: DRIVING UNDER THE INFLUENCE
RESULT: BROUGHT DOWN TO RECKLESS DRIVING & LATER EXPUNGED
Our client was charged with an OWI. This was the Defendant’s first OWI offense.
Because the Defendant did not hurt anyone, it was his first criminal charge and
he reached out to an attorney right away for help, Chris Aiello was able to get
the charge down to reckless driving. At a later date, Steve was able to get this
expunged off his record.
CHARGE: PROTECTION ORDER FOR STALKING
RESULT: CASE DISMISSED DUE TO PLAINTIFF’S CREDIBILITY
Our client faced stalking accusations in a child protection order. The
Plaintiff’s sworn affidavit contained disturbing claims that our client followed
her, pounded on her door and screamed at her without a clear reason. Chris
Aiello successfully demonstrated that the Plaintiff failed to mention that she
attempted to deny our client’s rightful court-ordered contact with their child.

FILE COMPLAINT
The spouse whose attorney files the divorce papers – which are called a
complaint – in the county of residence becomes the plaintiff in the case, and
the other spouse becomes the defendant.
ANSWER COMPLAINT
After you’ve been served or have had your spouse served, the defendant has
either 21 or 28 days to file a response, which is called an answer, and it
either admits or denies each claim made in the complaint.

AUTOMATIC STAY
While your bankruptcy is pending, an automatic stay will likely be filed. This
is intended to protect you from further debt collection on the part of your
creditors.
CONFIRMATION HEARING
Bankruptcy comes with a mandatory creditor’s meeting, which is also called a
confirmation hearing. Attending this meeting and making any payments required –
in a Chapter 13 bankruptcy – are important elements of the process.
CREDIT COUNSELING
Most people who go through the bankruptcy process are required to take a credit
counseling course that is designed to help them learn how to manage their
finances and balance their budgets moving forward.
FINAL DISCHARGE OF DEBTS
Finally, you’ll receive your discharge of debts. In a bankruptcy, you can
discharge – or offload – most unsecured debt, which doesn’t include things like
your mortgage or car loan.

FILE WILL IN PROBATE COURT
In Michigan, the will must be filed in the probate court in the county in which
the decedent – or the person whose will it is – lived. This begins the probate
process.
APPOINT A PERSONAL REPRESENTATIVE
The personal representative is someone who’s been appointed to oversee the
probate process and the administration of the decedent’s estate.
INVENTORY & APPRAISE PROPERTY
The next step in the process is inventorying the decedent’s assets and having
them appraised – as necessary. Depending upon the size of the estate, this can
be a laborious and time-consuming process.
SETTLE DEBTS & LIABILITIES
At this point, all the decedent’s debts must be addressed.
IDENTIFY BENEFICIARIES
Beneficiaries refer to the person or people who are identified in the will as
receiving specific assets.
DISTRIBUTE PROPERTY
From here, the remaining assets are distributed to the decedent’s beneficiaries
according to their wishes. When beneficiaries aren’t named, Michigan law
dictates that these assets flow to specific relatives.
CLOSE THE ESTATE
Once each step in the probate process is successfully addressed, the matter is
finalized, and the estate can be closed.

If the injured person is successful at trial and awarded compensation, the next
step is to collect the judgment from the defendant.
