Thanks.
I wish I should I have acted against the USCIS notice on july 2nd saying they
will reject. I should have listened to Rajiv khanna website who was saying that
the app should be filed even if it was sent back.
But my attorney said its no use to beat the system and I should wait till
october.
I listened and kept quite for few days and later decided on July 16th that What
the heck !!!. Let us submit even if it is returned and went ahead.

Every day matters as the counter is 180 days. It is like a time bomb clock.

I think now we can just mark on our calendars the 180 days which includes some
months of 31 days and mark exactly the date and time and plan to celeberate it
to fulliest.

Hi All,
If we can get one thing fixed, it should be about adding another step before
485, i.e. people should be able to apply for 485 without the priority date
getting current/get EAD so we can move to different companies. At-least it
clears lot of head-aches for me. I know that I am dreaming, but hey... that's
all I got.

You are right about to apply for 485 without the PD current. This will help all
the people who are bound to their employers and have no option. The law makers
are trying to find fraud in employment but they are not finding ways to
unshackle the employee from employer.

I am new here and I have few questions to IV core members.

Did we consider any other avenues find out is there any way out to influence DOS
visa availability.

How did Nurses was able to accomodate their visa numbers without any bills are
ammendments ( I know there is lot of demand for nurses)

you guys are doing a great job lobbying congressmen, but I think we should also
consider finding out how current law if implemented properly can reduce the
backlog and reduce retrogression.

for example we should make sure 245i case should not effect our visa numbers, I
belive we can work these hurdles while we wait for current immigration debate to
complete.

I called several senators last week and discussed with their immigration
specialist, I got a feeling this debate is more about illegal aliens and about
hispanic votes not many of them are considering legal aliens and issues.

The visas for nurses and schedule A was the result of a bill passed around May
2005 which recaptured unsued visa numbers and gave them only to schedule a.

Do women have to fill in the DS 157?
It shows up as a required to fill form for my wife?

Yes - now its based on age. You do not require DS-157 for children and seniors.
Everyone else requires that.

Hi
My status has changed recently from H4 to H1. I haven't got my H1 visa stamped
in passport. I need to travel to India due to family emergency.
1. Can I get an emergency appointment?
2. Would I have any problem related to transit visa if travelling via Amsterdam
or Frankfurt?
3. How long does it take to recieve the passport after stamping?

Any help would be greatly appreciated.

I am trying to send AC21 letter to USCIS through my attorney. My attorney want
the LC filing papers from my previous employer.(so that he can prove that my
current job is same or similar)

So if we change our job using EAD, do we need to have LC filing paper from our
ex employer for invoking AC21?.

Go to their website and look for consitutent services. Utilize their services
ONLY if your's is a genuine problem and follow their instructions - write
clearly what your problem is and what kind of help you are expecting. Spome of
them are very helpful - they stay on top of the case till they get you a written
decision

for actual RFE mail notice. I talked to IO and she said mail notice sent to my
home adress? Typically, how long it takes to receive mail notice? 1 week or 2 to

Thanks everyone for the feedback. Can some guru put this issue to rest? I guess
the only question that remains is:

"For a person who has extended his H1 beyond the 6 year category on the basis of
AOS, would this H1 extension be valid if I-485 is denied (either wrongly due to
AC21 or otherwise)"

Hi Indyanguy,

This is an excellent question and I was also looking for an answer. I am into my
6th year of H1-B(exactly 5 years 1 month) and also have an approved EAD & AP.
I have a great JOB offer but hesitating to invoke AC21(moving using H1-B/EAD)
because these days there are many 485 DENIALS( the moment I1-40 is REVOKED). And
NOTHING is guaranteed even if we send the AC21 documents to USCIS. And the EAD
automatically gets invalid anyways when the 485 is denied.
Doing some research to find out if H1-B extension beyond 6th year is valid if
485 - gets DENIED? (Example: If I get a 3 year H1-B extension based on my
current I-140 approval)?

Also not sure if it applies in my case as I still have 10-11 months of H1-B
remaining and if I decide to take up this oppurtunity in the next couple of
months and 485 gets DENIED after that. May be I will have enough time to file
MTR? I should be fine. But what if 485 gets DENIED after I complete 6 years?

Please provide genuine answers.
These answers will BENEFIT many people.

There is a spillover of 22000 visas from FB to EB starting Sep 01 2008. Does
anybody know how this spillover is divided between EB1/EB2/EB3?

Can we expect 28.6% of this spillover in EB3? Just like we get 28.6% of annual
quota?

per them, one can do transfer and extension of H1B even after using AP as long
as the current I-797 is still valid.

Imagine if Uncle Sam held an auction to allow you to submit I485 EAD AP, what
would you have bid for the right to submit?

Maybe $640, $6,400, or even $64,000?

If Uncle Sam charged a fee to submit now rather than waiting for another year or
two or three... What would you have paid to submit I485 and get EAD AP AC21?

Alternatively, how much are you going to benefit from EAD AP or AC21?

AC21 -- maybe ability to move jobs and get a few thousand $ pay rise?
AC21 -- maybe not going to the back of the queue -- really worth thousands!
EAD for you and spouse -- maybe a week of salary for someone that could not
previously work?
AP -- how much is it worth not to have to waste time and money renewing H1B at
an embassy. That's at least a few days of time you don't have to waste (and time
is money).

How much will you save from filing under the old fee structure? At least a few
hundreds.

Now use that as a guideline for what you are going to contribute to IV.


There are still problems ahead for most....
* retrogression
* BECs for unluck some
* name checks (I personally know someone that it took almost 2 years for).

IV is now the most credible organization there to help get these issues
addressed. So let's hand over the $.

@ cali - talk to senators's immigration liaison and explain the contradicting
response(s) that you are receiving and ask if they could help - at this time
lets take a diff approach - let them ping USCIS rather that you..see if that
works.

USA has a right to choose who they give green card to but not fool Indian people
by swinging visa bulletin by 4 years every now and then. Not by discriminating.
There should be some transparency to the process and law should be followed. If
USA makes a law that Indians wont get GC in EB, I am happy to note. Can they
remove their gloves?

EB-3 India is last in the line so first EB-2 (WW) than EB-2 India/china/mexico,
then EB-3 (WW) then EB-3 India/China/Mexico... basically my common sense tells
me EB-3 India will get a big 'ZERO'....
