Not only that, Judge Lyle Frank tossed the larger lawsuit the UFT filed in March. The union was challenging the city’s decision granting Success Academy space for its schools on grounds the approval failed to take into account a new law mandating that public schools reduce class sizes. In June the charters were put under a temporary restraining order that limited the repairs they could do to their allocated spaces to prepare them for the school year. Typically, the UFT’s filing came late Wednesday night, only days before the school’s opening. The union claimed the “myriad harms and safety concerns” created by the building improvements Success was carrying out had become “urgent.” Among the examples the UFT cited was that Success Academy workers were “stealing candy.” Thank goodness Judge Frank put the kibosh on this effort. It’s the latest example of the unrelenting harassment the teachers unions employ to prevent anything that might compete with their failing schools. But it didn’t help that Judge Frank had left Success Academy and the families it serves in limbo, issuing his ruling at the last minute even though the suit was filed months ago. New York’s parents understand what’s going on, and they are voting with their feet. The city’s Department of Education reported that last year’s K-12 enrollment in traditional public schools was 906,977—down nearly 10% from 2019-2020. Over the same time charters grew to 141,091 students from 129,523. The union’s obstruction is obscene. Success Academy is among the best charter networks in the nation, and it gives better options to children who most need them. The UFT has proved again it doesn’t care about the roughly 450 Success students whose educations would have been disrupted if the union had succeeded in its lawsuit. Given how often charter operators are dragged into court, you’d think it was a crime to fight to ensure that children of color have a decent public school.
