Objective and Purpose of the Assignment

The Asian Development Bank (ADB) is seeking a Water Resources Management
Assistant (WRMA) to support to
a team of consultant and the Ministry of Agriculture and Rural Development in
reviewing the Hydraulic
Work Law. The aim of reviewing is to identify areas that require adjustment to
align with international
standards, address emerging challenges, and accommodate changes in policy and
development priorities.
This TOR delineates the primary responsibilities and expected outcomes
associated with the Assistant’s
role, spanning 110 working days over a twelve-month period.
The WRMA will work with and provide support to the consultant team and relevant
Vietnamese authorities
to achieve the following objectives: (i) Conduct a thorough review and analysis
of the existing
hydraulic work law, identifying areas that require adjustment to align with
international standards,
address emerging challenges, and accommodate changes in policy and development
priorities. Facilitate a
comparative analysis of hydraulic work laws from other countries in the region
or globally, providing
insights into effective legal provisions, mechanisms for stakeholder engagement,
and successful
approaches to water resource management and climate resilience; and (ii)
Organize workshops, seminars,
and consultations to engage a wide range of stakeholders, including government
agencies, local
communities, civil society organizations, and the private sector. MARD will
provide the necessary
reference materials and logistic support to follow a participatory approach.
This work includes desk
studies, field surveys to collect the updated data/information, consultation
with stakeholders,
verification of information, liaison with MARD’s Working Group and other
relevant government
authorities, report writing and outcomes dissemination.

Scope of Work

The WRMA reports to Team Leader (TL) and will carry out, but not limited to, the
following activities
and tasks:

 * Provide input and assistance for reviewing the existing Hydraulic Work Law
   and identifying areas for
   improvement to address emerging challenges.
 * Collect, compile, and maintain comprehensive related data/information and
   records. Prepare accurate
   and visually appealing graphs, charts, and tables as requested by TL.
 * Generate technical analyses concerning irrigated areas, investments,
   Operation & Maintenance (O&M),
   etc.
 * Establish, maintain, and foster positive and effective working relationships
   with stakeholders
   encountered during the course of work.
 * Contribute to consultation workshops, seminars, and reports as requested by
   the TL.
 * Provide support to the team leader and MARD in preparing the proposal for law
   revision.

Detailed Tasks and/or Expected Output

The WRMA, with inputs and support from other specialists will submit the
following deliverables:

 * Comprehensive and well-maintained water resources related data, information
   and records as guided by
   the TL.
 * Positive and effective working relationships with stakeholders.
 * A collaborative report with other experts and relevant Vietnamese authorities
   outlining proposed
   adjustments to the Hydraulic Work Law based on the findings from the review.
 * Meaningful contributions to consultation workshops, seminars, consultations
   and reports as requested
   by the TL.

Note: The TOR may be subject to revision and refinement in consultation with
MARD, based on the specific
requirements and circumstances of the assignment.

Minimum Qualification Requirements

The WRMA should possess the following qualifications:

 * A postgraduate degree in Water Resources Management, Environmental Law, or
   related field with a
   minimum of 5 years of relevant experience in preparing technical reports,
   presentations related to
   policy review or irrigation practices.
 * Strong data compilation and visualization skills. Ability to interpret
   complex data and reports
   effectively.
 * Strong facilitation and communication skills, with experience in organizing
   workshops, seminars, and
   consultations.
 * He/she must have excellent written and oral communications skills in English.
