HOUSE ADDS RESTRICTIONS FOR MEDICAL-CANNABIS USERS

PIERRE, S.D. (KELO) — If the governor agrees, the names of people certified for
South Dakota medical cannabis cards will be added to the state’s prescription
drug monitoring program.

By a 57-12 vote on Thursday, the state House of Representatives gave final
legislative approval to that change and an assortment of others contained in
SB42.

The House also passed SB10 that would require a notification of medical cannabis
certification be provided to a patient’s primary or referring practitioner.

The 48-21 vote sends it back to the Senate for a decision on whether to agree
with a change made by a House committee.

An attempt Thursday by Republican Rep. Fred Deutsch to criminalize failing to
provide the notice fell short, 25-44.



Democratic Rep. Kadyn Wittman said she feared that Deutsch’s amendment would
place the certifying provider fears “inadvertently in danger” if a patient lies
about having a primary provider.

Republican Rep. Roger DeGroot read the list of health conditions that are needed
to qualify for a medical-cannabis card. “How in the world do you go to a popup
clinic and not have a medical provider? It makes no sense at all,” DeGroot said.

Replied Deutsch, “We know that happens all the time.”
