Show More NEWS HAYS COUNTY GRAND JURY CLEARS SMPD OFFICER IN FATAL SHOOTING By Natalie Frels • 14 Aug, 2024 SAN MARCOS, Texas – The office of Hays County Criminal District Attorney Kelly Higgins announced today that a Hays County Grand Jury concluded its review of the April 11, 2024, shooting in which a San Marcos Police officer fatally shot 22-year-old Malachi Williams. The shooting occurred on April 11, 2024, in the parking lot of the H-E-B grocery store at 641 E. Hopkins in San Marcos. The Grand Jury considered the evidence and determined that the officer’s actions were justified under Texas law. No indictment was issued in the matter. As part of its review, the Grand Jury received evidence regarding a separate incident that had occurred approximately an hour prior to the shooting. In that incident, Malachi Williams had been waiting outside of a Snax Max convenience store on Hopkins and followed two men who had left the store as they walked home in the dark. The men reported that Williams followed very closely behind them and that his behavior made them uncomfortable. After they had been followed for a couple of blocks, they confronted Williams and he produced two large knives, one in each hand, and threatened them. They immediately called police to report what had happened. SMPD officers responded and initiated an investigation for aggravated assault with a deadly weapon. After speaking with the two men, officers began searching the area for Williams. At approximately 10:35 p.m., Williams returned to the Snax Max store and went into a restroom at the back of the store. A SMPD officer arrived less than one minute later and waited near the front door until Williams came out. That officer had interviewed the victims of the earlier incident and was aware that Williams may have been armed with multiple knives. At that point, the officer asked Williams to step outside. During the encounter, Williams ignored the officer’s repeated commands to turn around and put his hands behind his back. After exiting the store, Williams continued ignoring the officer’s commands and, instead, turned and ran. He was pursued by multiple officers. The officer attempted to deploy his taser twice while running and both attempts missed. During the pursuit, the officer noticed that Williams was running with the knives in his hands. After running to the northwest along Hopkins, Williams cut through a parking lot and headed directly toward the H-E-B, which was open at the time. After they entered the parking lot of the grocery store, the officer shot Williams, striking him twice. Despite attempts at life saving measures, he did not survive. The Texas Rangers conducted the investigation into the shooting with the assistance of the San Marcos Police Department. “The Hays County Criminal District Attorney’s Office presented the results of the investigation to the Grand Jury,” said Higgins. “After hearing the evidence, the Grand Jury determined that the conduct of the officers was justified under the law and voted not to indict. This matter is now closed.” He added, “We are saddened by the loss of life, but the actions of Mr. Williams posed a threat to public safety. This officer was forced to make a difficult decision in order to protect the public.” KYLE MAN SENTENCED TO 40 YEARS IN PRISON By natalie frels • 14 Aug, 2024 SAN MARCOS, Texas – The office of Hays County Criminal District Attorney Kelly Higgins announced today that 45-year-old Josh Devereaux Jarratt of Kyle entered a plea of guilty to the offense of continuous sexual abuse of a child and was sentenced to 40 years in prison on August 12, 2024. Jarratt also pleaded guilty to two counts of indency with a child by contact, one count of indency with a child by exposure and 30 counts of possession of child pornography. He will not be eligible for parole and must serve the full 40-year sentence due to the conviction of continuous sexual abuse of a child. Over the course of several years, Jarratt sexually abused a child in his home. In 2021 that child outcried to a friend and that outcry led to an investigation into Jarratt by the Hays County Sheriff's Office. The child victim also provided information to detectives that Jarratt possessed child pornography. A search warrant was obtained for Jarratt's home and detectives found multiple computers and electronic devices that contained more than 1,000 videos and images of child pornography. During the search of Jarratt's electronic devices, detectives also found multiple explicit videos and photos that Jarratt took of a child. A child-sized sex doll was also located in his bedroom closet. Hays County Assistant Criminal District Attorneys Miranda Ebersole and Daniel Sakaida prosecuted this case. The Hays County Sheriff's Office investigated the case, and the prosecutors would like to express their appreciation for Jennifer Baker and Det. Nelson Wray for their extensive work on this case. ### US 290 AT TRAUTWEIN ROAD REOPENS TO TRAFFIC By natalie frels • 07 Aug, 2024 HAYS COUNTY, Texas – After beginning construction in February 2024, the detour at US 290 and Trautwein Road will be removed and Trautwein Road will be open to traffic starting today, August 5, 2024. Motorists can expect traffic patterns to return to normal, with the right turn lane from westbound US 290 to Trautwein Road open as well. Hays County, in partnership with the Texas Department of Transportation, planned improvements to Trautwein Road at the intersection of US 290 to increase visibility and safety for travelers. During construction, Trautwein Road was closed to through traffic and a detour was set in place. Improvements included in this project are: Lowering Trautwein Road at US 290 to improve visibility Adding a dedicated right turn lane from westbound US 290 to Trautwein Road Adding retaining walls to Trautwein Road Improving intersection signal on US 290 Hays County Commissioner Walt Smith, who championed this transformative project, proudly shared, “This project has been a passion of mine since taking office in 2019.
