A trade group for information technology companies can join in the defense of a
Trump-era rule that overhauled the visa lottery system for skilled foreign
workers, a federal district court judge ruled.

A group of workers sued the Department of Homeland Security over the new H-1B
visa lottery last year, alleging the regulation has fueled fraud by allowing
companies to file multiple registrations on behalf of a single individual. That
disadvantages workers for whom an employer has submitted one registration, the
plaintiffs argued in their lawsuit.

The lawsuit survived a motion to dismiss by the department in December. A motion
for summary judgment filed by the plaintiffs is pending before U.S. District
Court Judge Trevor McFadden in Washington, D.C.

ITServe Alliance, an organization that represents more than 1,200 information
technology firms, filed a motion to intervene in the case earlier this month,
seeking to bolster the government’s defense of the rule. The group argued it had
an interest in defending against accusations of fraud in the visa registration
system, and said the government doesn’t adequately represent the financial
interests of firms in the information technology sector.

McFadden approved the motion Jan. 20, finding that ITServe and several
information technology firms met the requirements to intervene in the lawsuit
for reasons that would be spelled out in a forthcoming opinion. The groups must
file a cross-motion for summary judgment by Jan. 21, the judge wrote.

“It was obvious from the start that the law was on our side,” Jon Wasden, an
attorney for ITServe, said in an emailed statement in response.

Charles Kuck, an attorney for the plaintiffs, said the decision “changes nothing
about the case, our timeline holds, and we remain confident in our ability to
restore the H-1B lottery to its proper format and away from the raffle system
engendered by the current regulation.”

ITServe Alliance previously sued to block a separate Trump administration H-1B
rule that mandated higher wages for H-1B visa holders. The Department of Labor
later announced an 18-month delay of the rule, in May 2021.

H-1B visas, which are popular in the tech industry, allow highly skilled foreign
workers to secure employment in the U.S. for up to three years, with the option
to renew for another three. Up to 85,000 visas are available annually, including
20,000 for workers with advanced degrees.

The case is Liu v. Mayorkas, D.D.C., 1:21-cv-01725, 1/20/22
