House Democrats urged the National Labor Relations Board to return to its
Obama-era legal test for determining whether a small unit of employees within a
larger workplace is appropriate for a union election.

The board should scrap its standard for small units—often called “micro units”
by management attorneys—from its 2017 decision in PCC Structurals , 14
Democratic lawmakers on the House Education and Labor Committee said in a brief
Friday.

Returning to the framework for smaller units from the NLRB’s 2011 decision in
Specialty Healthcare would “prevent employers from gerrymandering union
representation elections,” the lawmakers said.

The Democratic-majority NLRB called for public briefs as it considers
overturning PCC Structurals, which made it easier for employers to argue that a
union has proposed an improper unit.

The impact of that Trump-era standard was on display last summer in a case
involving the International Association of Machinists’ attempt to organize 87
tool-and-die workers at a Nashville-area Nissan automotive plant. An NLRB acting
regional director ruled in June that the union would have to organize a
wall-to-wall union of 4,300 workers. The board in December agreed to reconsider
that ruling.

The AFL-CIO and the International Brotherhood of Boilermakers also filed
separate briefs Friday with the NLRB calling for the return of the Specialty
Healthcare standard.

The Society for Human Resource Management filed a brief asking the board to
retain the PCC Structurals test, saying that it “strikes the appropriate balance
between ensuring meaningful collective bargaining while preventing the
proliferation of multiple bargaining units within a single workforce.”

The NLRB is reconsidering its test for smaller units in a case involving a bid
by an affiliate of the International Association of Iron Workers to organize
journeyman and apprentice field iron workers at American Steel Construction Inc.
The company argues that only a plant-wide unit would be appropriate.
