PROBATE PROBLEMS

 * When someone dies it’s one of those painful experiences. There’s lots of
   things to do, we’ll help you with all of these.
 * Hopefully they’ve made a will. If so this is followed and the beneficiaries
   receive their gifts. If someone hasn’t made a will they die intestate. If
   there’s no will this may cause some problems which we can resolve.
 * Probate is the process of gathering in someone’s assets and passing them on.
   We’ll calculate the inheritance tax, complete the tax and probate forms and
   apply to the probate registry for the grant of probate.
 * We are Solicitors, but we keep our costs low for you.
 * We’d rather Beneficiaries receive lots of inheritance, more than a large bill
   from us.

OUR PROBATE SERVICES

 * We’ll help you through the complexities of the Probate process.
 * We’ll check there’s a will and is it valid? Not all wills are valid. If it’s
   not valid or there’s no will, we’ll start the process of identifying
   beneficiaries under the Intestacy Rules.
 * We’ll search for and gather in their assets, then value these for Tax
   purposes. We’ll work out the Inheritance Tax and if relevant Capital Gains
   tax. We’ll contact the Tax Office on your behalf to resolve any issues. Next
   complete the Inheritance Tax forms and submit these to the Tax Office, along
   with the completed Probate Office forms. We’ll draft the required Legal
   Notices about their death, then organise any debts or Tax to be paid. Finally
   distribute their estate to their beneficiaries. If there’s a trust in their
   will make arrangements for this to be activated.
 * Sometimes someone claims against the estate. They might be unhappy with the
   will as they’re not getting anything. It could be family member who believes
   they should be looked after and the will should’ve said so. There’s also
   family disputes over an estate which we can also handle. As a solicitor’s
   firm we can handle these claims.
 * We also provide you with information to manage assets using trusts and other
   ways of organising finances.
