Omaha and Lincoln process servers are used in a variety of tasks such as serving
summonses, subpoenas, mechanics liens, and notices, as well as sometimes
document retrieval. The main job of a Lincoln and Omaha process serving company
is to serve legal documents to a defendant, a witness, records custodian, or
other interested party in a court case.

After serving any legal documents, Lincoln and Omaha process servers must
provide the client with an affidavit to be filed by the client with their court
to prove the service of process was completed. States vary as to whether the
service of process must be notarized.

Omaha and Lincoln process servers are legally required to serve papers in the
correct manner laid out by the state where the legal documents
originated. Process serving laws vary by state, so each individual process
server should be advised by his out of state client if there are any particular
laws to be followed exclusive to the state of origin.

Florida documents require certain notations on the service document to be made
by the process server when effectuating service.  Most states allow process to
be served seven days a week except, most notably, Florida, New York and Texas. 
They do not allow Sunday service.

If there are any laws specific to your state, let your process server know in
writing prior to the service of process.

Why Should I Hire a Process Server?
Typically, a process server is more tenacious than law enforcement in atempting
a service of process.   A process server will attempt a serve when they are more
likely to be successful rather than when they may be in the neighborhood. 
Further, a process server will likely attempt different day parts and various
days of the week in order to ensure success.

Having said that, successful service is not guaranteed.  See below under "What
is Due Diligence?"





What are the Responsibilities of a Process Server?
A process server is required to serve various legal documents to a party in a
lawsuit. They do not deliver, they serve.  This includes summonses, subpoenas to
third parties to testify in court or produce documents, formal complaints, and
writs.
A process server can help you locate a defendant to provide service of process,
but that is an additional fee. Most states require process servers to be of a
certain age and have no interest in the case.

A process server cannot and should not provide legal advice.  If you are
representing yourself, it is up to you to research legal questions on your own. 
However, it is advisable that you get legal counsel to represent you instead.





What is Due Diligence?
No process server can guarantee service will be successful.  All a professional
process server can affirm ist hat due diligence will be conducted for a certain
number of attempts the client pays.

Due diligence is an earnest effort to try to have successful service; different
times of day, different days of the week.


Depending on the circumstance, the process server may knock on a neighbor's door
if they do not get an answer at the address they are attempting to service.  The
process server may make note of license plates, current landscaping, a large
volume of mail sticking out of the box, dogs barking in the house, etc.





Do I Want Routine Service, Rush Service or Priority Service?
Different people define these terms in various ways.  The best thing to do when
you ask for a price quote is to immediately inform the process serving company
representative if you need it done same day, tomorrow, in two days or if it is
routine service.  Routine service can be one week or more.  In other words, be
specific as to what your deadline is.  State the date rather than use a term
such as routine or priority.

You will most likely pay more if you need the serve expedited or if you need the
server at a location attempting service at a specific date and time.





How Much Does a Process Server Cost?
If you are a law firm with bulk serves on an ongoing basis, you are likely to
get a volume discount.  If this is a one time need or you have fewer than ten a
month, you could expect to pay $75 and up.  There will be additional fees for
time and mileage if there is not a server near the service address.

You will also pay an additional fee if you want the process server to skip trace
or locate an address for the person or business served.  This averages $99 and
up.





What is an Affidavit of Service or Return of Service?
Upon completion, the process serving company will provide you with a Proof of
Service.  Whether this be a notarized affidavit for a summons (an affidavit of
service), or a return of service acknowledging the serve or non-serve of the
party.  Typically, subpoenas do not requirea notarized affidavit and a return
signed by the process server is sufficient.
