Skip to content LAW AND POLITICS WITH HUBERT Get Involved Menu * Home * Contact CORRUPTION WATCH:CEO OF ZONGO DEVELOPMENT FUND CAUGHT UP IN A ¢5M PROCUREMEN SCANDAL A Corruption Watch investigation has uncovered that the Zongo Development Fund (ZoDF) has engaged in alleged procurement malpractices in the purchase of goods, services and works worth ¢5 million. The management of ZoDF allegedly superintended procurement breaches such as inflation of contract figures and breaching of entity head’s threshold. Corruption Watch established that ¢200,000 of the ¢5 million was spent on a contract for Covid-19 PPEs. In addition, ZoDF was alleged to have spent more than ¢4.8 million to procure office cabinets and ICT equipment and accessories; recruit contractors for the installation of streetlights and drilling of mechanized boreholes; and the engagement of consultants for various services. Chief Executive Officer of the Fund, Arafat Sulemana Abdulai conceded in an interview with Corruption Watch that he “went beyond” his threshold in the approval of the ¢200,000 contract for Covid-19 PPEs. Sulemana Abdulai, as the “head of entity” of ZoDF, per the Public Procurement Amendment Act, 2016 (Act 914) is permitted to approve procurements that are worth ¢100,000 and below. S ulemana Abdulai was appointed in September 2019 as ZoDF CEO following the death of the then CEO, Mohammed Baba Alhassan in August 2019. He was previously the technical advisor to the late CEO. The procurement of the Covid-19 related items, namely bottles of sanitizer, bottles of liquid soap and bundles of nose masks is one of the major transactions he has overseen. The contract was awarded to Focus Women Network on March 25, for ¢200,000 after which Sulemana Abdulai wrote to the Public Procurement Authority (PPA) to request for ratification of the contract because he had breached his permissible threshold as head of entity. According to our sources, Sulemana Abdulai sidestepped ZoDF’s entity tender committee (ETC) in the award of the contract even though the transaction was beyond the permissible threshold of the head of entity. Section 18 (3f) of the Public Procurement law stipulates that the head of entity “shall” refer to the entity tender committee for approval, a procurement above the approval threshold of the head of entity. According to our sources, the transaction raised eyebrows because of the manner in which the contract was executed. They allege that the purchase, which was not preplanned started off under the price quotation method of procurement but eventually ended up as a single sourced contract. In an interview with Corruption Watch on Monday August 10, 2020, during which he was aided by eleven other officers, Sulemana Abdulai confirmed that having breached his permissible threshold he wrote to the PPA for ratification. Now, to the matter of spending without approved procurement plan. Corruption Watch also reports that auditors examining ZoDF books have, in their preliminary queries, raised questions about the proprietary of spending the ¢4.8 million on procuring office cabinets and ICT equipment and accessories; recruiting contractors for the installation of street lights and drilling of mechanized boreholes; and engaging consultants for various services because the transactions occurred when the Fund did not have an approved procurement plan. According to close sources, as of the end of the first quarter of this year, the Fund did not have in place an approved procurement plan for the 2020 financial year. This, according to our sources breaches Section 21 of the Public Procurement Act, 2003 (Act 663) as amended by Act 914 of 2016. Section 21 of the public procurement law stipulates that a procurement entity “shall” prepare a procurement plan to support its approved programme. The law further requires that a procurement entity shall have its entity tender committee approve its procurement plan for the subsequent year not less than one month to the end of the current year. This means that the ZoDF procurement plan for the year 2020 should have been approved no later than the beginning of December 2019. To reinforce this provision, the PPA on May 19, 2020 published an advertorial on its website (https://ppa.gov.gh/advertisers-announcements/) to remind public institutions of their obligation to furnish the procurement authority with their procurement plans for year 2020. The PPA stated that “In accordance with Section 21 of Act 663 as amended, the Authority is reminding” all entities to submit their procurement plans latest by 29th May, 2020. “The authority indicated that its governing board would not consider “any applications for the use of Sole Source and Restricted Tendering unless due reference is made to those Packages as captured in their approved procurement plans…” During our interview with Sulemana Abdulai on August 10, 2020, he said ZoDF has an approved procurement plan for 2020 but could not say when the ZoDF ETC approved the procurement plan. From gunshots at various registration centres to physical assaults, the exercise had resulted in the death of two people, countless injuries and arrests. Regardless of these incidents, the Electoral Commission continues to tout the overall success of the exercise which was finally wrapped up with a two-day mop-up exercise on Saturday, August 8, and Sunday, August 9, 2020. It is unclear where the people were being bused from. The NDC has had cause to complain over what they say is the use of military personnel to intimidate some legitimate Ghanaians from registering on the basis that they’re foreigners being bused from border towns into Ghana. The Council indicated that it has reported the matter to the relevant security authorities about the threat posed by the persons behind such activities. WAEC assured that it has put in place measures to ensure the smooth conduct of the 2020 WASSCE and urged candidates to stay focused, continue with their preparations for the examination and comply with the COVID-19 protocols in order to stay safe during the period. On its part, the Ghana Education Service in a statement signed by Head of Public Relations, Twum Cassandra Ampofo while noting reports that the said paper has been deliberately leaked to ensure candidates pass the exam stated that the question paper making rounds is a fake one and underscored that there is no WASSCE paper written by Ghanaian candidates called General Paper as has been labeled in the circulating images. According to the GES, the purported leakage of question papers over the years has become an annual ritual with this year’s situation not being an exception. She stated that school authorities rushed Ms Sika Addo to the Tetteh Quarshie hospital right after her friends reported she was unwell on Thursday. According to Adom News’ Seth Ankomah Adjei, the Nigerian community is seeking answers as they do not understand why the man know as Precious was shot. According to his nursing mother wife, the deceased came over to the hotel they were staying to tell her that someone had threatened to kill him. She said when they left the hotel to go home, her husband was anxious as he said his assailant could pursue him. According to her, they went to a friend’s house and when they got there, Precious shouted for the neighbours to come out because his assailant was still on his tail. ‘The neighbours came out in their numbers and my late husband retraced his footstep to look out for the assailant. It took a long time and Precious was not returning so some of the people around followed up. “Then someone called to tell me that Precious has been admitted to the hospital after he sustained a knife wound. When I insisted that I wanted to go see him they said no and locked me in the room. “I later realised the police have shot and killed my husband. He has opened a shop for me here and people around know him very well…he is hardworking and does not steal so I don’t know why he was killed,” the mother of the five-week-old baby told the reporter. The angry mob besieged the police station demanding answers. Some of them threw stones into the Police Station after they were sacked from there. Despite the usual show of respect and love at public events, the two NPP bigwigs are believed to have a frosty relationship. According to Asiedu Nketia, their relationship broke down completely during the 2008 elections. Asiedu Nketia claimed on Asempa FM that the perceived lack of support from Kufuor for candidate Akufo-Addo was the final straw in their already strained relationship. General Mosquito as he is affectionately called, narrates that in the lead up to the 2008 elections run-off in Tain, Nana Akufo-Addo accused Kufuor of not rigging the votes in his favour. He alleged that Kufuor and Akufo-Addo fought at a residence of former Prime Minister, Busia ahead of the Tain elections. “Before we went to Tain for the run-off, President Kufuor said that whoever wins, he will hand over to him. Because of that when the NPP officials got to Busia’s house in Wenchi, Kufuor and Nana Akufo-Addo fought. Nana was angry that Kufuor was not using incumbency to rig the elections. So, they fought in Busia’s house”, he said. Asiedu Nketia also detailed how the NDC derailed a plot by the NPP to rig the 2008 elections in the Ashanti Region. He says that the NPP, with the connivance of some EC officials attempted to inflate figures but the ‘vigilant’ NDC elections officials caught them off guard and reported the issue to then EC boss Kwadwo Afari Djan. “In 2008 certain things happen. They divided certain constituencies in the Ashanti Region. Ejisu for instance was divided into Juaben but their numbers was huge. Between 2004 and 2008 the numbers of some constituencies more than doubled so we raised concern. Eventually the EC agreed with our figures. President Akufo-Addo directed that all final year Senior High School (SHS 3) students, together with SHS 2 Gold Track students who resumed academic exercise on 22nd June, 2020 to complete the academic calendar must be in the boarding house as a measure to control the spread of Coronavirus in schools. However, due to the awkward situations the two final year students find themselves, they have not been able to resume academic work despite being willing to write the West Africa Senior High Certificate Examination (WASCE) starting this month. But one of the lactating students on Tuesday wrote to the Headmaster of the School and copied the District Director of Education Service about her condition asking for permission to come to school from home to enable her take care of her child and at the same time partake in learning to prepare for the exams. A family member of the student, told Starr News “she was a boarding student but got pregnant and delivered just before government reopened schools so it means we had to take her from the boarding to stay in the house. But because of the directive that all the students should stay in school she was not able to go because of the child. So we wrote a letter to the headmaster begging him to let her go to school from the house. So she has been going to the school just that she feels tired and always be sleeping in class because the baby doesn’t allow her to have enough sleep.” Starr News has gathered that the lactating student has been betrothed to the man who impregnated her at Tease Community where she is cohabitating. One other lactating student and a heavily pregnant student are, however, yet to report to school due to the unfavourable boarding directive. Teenage pregnancy is prevalent in the Afram Plains area due to poverty and other socio-economic factors. Many victims of teenage pregnancy are forced into marriages with the perpetrators by their parents. The Chief Executive Officer of International Child Development Program (ICDP) Joyce Lanyo, says it is important for stakeholders in the District to ensure that the students are supported to write the exams and prevent being forced into marriage with the perpetrators. ICDP which is implementing Partner for Girls Advocacy Alliance a project initiative of Plan International Ghana seeking to eradicate Child marriage and gender based violence said, many teenage girls are being forced into marriage at the expense of their education during such situations. According to the president, the basis on which the requests are being made were taken into consideration prior to the decision, therefore, bringing back the Auditor-General on those bases is impossible. “The president encourages people to be citizens and not spectators and therefore, your petition is welcome and its contents have duly been noted. “However, the position of the President as contained in the letter dated July 3, 2020, from this Office to the Auditor-General remains the same,” a statement signed by Secretary to the President Nana Asante Bediatuo said. President Akufo-Addo last month ordered the Auditor-General Daniel Domelevo to take an accumulated leave of 123 days, which was further extended to 167 days. Although the President justified his actions with sections 20 (1) and 31 of the Labour Act, 2003 (Act 651), the decision has been one that has received massive backlash from some members of the public including the Coalition of CSOs in the country. The act, according to the Coalition, threatens the independence of the Auditor-General and downplays Ghana’s effort to fight corruption. Subsequently, London-based Ghanaian Korieh Duodu, and Lolan Sagoe-Moses on July 8, 2020, petitioned president Akufo-Addo to reinstate the Auditor-General but the president insists he cannot grant any of the requests. “The arguments made in your petition were considered prior to the President taking the decision to request Daniel Domelevo to take his accumulated leave from 1st July 2020. “Accordingly, the president is unable to grant the request in your petition,” the statement further said.
