A Leicestershire GP surgery has had its contract to treat NHS patients terminated amid concerns about the way it was being run. The ruling Leicester, Leicestershire and Rutland Integrated Care Board (ICB) says it served notice on Spectrum Health because its surgery in Oadby had been falling short of the standards required and had failed to address its previous concerns. The ICB has declined to disclose details on exactly how the surgery had fallen short of the standards required. However, police and NHS counter fraud officers are also investigating allegations the surgery received public money for services it never provided. LeicestershireLive also published messages in May that one of the partners in the practice, Shaun Chadwick, sent a former colleague a message saying 'karma is a bitch' after she was diagnosed with Multiple Sclerosis. Another colleague also received messages from Mr Chadwick of regularly 'fat shaming' her. He denied the claims, with a spokesman calling them "grossly inaccurate and insulting". READ MORE: Woman, 28, dies after village hit-and-run sparking murder investigation Patients have been assured the surgery will continue to run under its current management until a 'caretaker' is found to take over. Surgery staff will have the chance to transfer to the caretaker, but the partners in the practice will not. A spokesman for Spectrum Health said it feels the decision of the ICB is heavy-handed and has vowed to mount a legal challenge. Caroline Trevithick, chief nursing officer and deputy chief executive for the LLR ICB, said: "We have taken this action because the practice has not addressed prior concerns relating to the way operates, and non-adherence to standards all practices are expected to comply with. Our number one priority now is to ensure patients can continue to receive the care that they need. "We fully acknowledge that patients will have some concerns and we will be contacting them to fully explain the position and keep them updated. We have started the process of putting in place caretaker arrangements and in the meantime, patients should continue to use the practice as normal." The Spectrum Health surgery in Oadby re-opened in September 2020 following an extensive refurbishment In regards to the fraud investigation, a spokesperson for Leicestershire Police said: "In October last year, a report was received from Action Fraud concerning fraudulent activity at a medical practice in Oadby. It was reported that payments had been received for services which had not been provided. "Following enquiries led by the force’s Economic Crime Unit (ECU), a 34-year-old man from Great Glen was arrested on suspicion of fraud by abuse of position on Tuesday 10 May. He has since been released under investigation." A spokesman for the ICB added: "Any investigation relating to alleged fraud allegations is a matter for NHS Counter Fraud and the Police." Mr Chadwick, acting as spokesperson for Spectrum, confirmed the practice has been assisting Leicestershire Police with a possible fraud enquiry. He claimed he was the one who originally raised fraud concerns on February 15 and sought permission from the ICB to invite the police into his practice and help investigate matters. He further alleges that "at the time, he was surprised to received an email from the CCG advising him to keep his ‘concerns and suspicions’ to himself." The surgery has also been rated inadequate in a report by the Care Quality Commission (CQC) after it received the lowest possible marks for leadership, safety and effectiveness of its services during the inspections in June. However, it was rated 'good' for how caring its services were and being responsive to patients' needs. Inspectors found the surgery deleted more than 1,200 patient letters - which the surgery says was down to human error - and not actioned a further 120 letters. The CQC also said staff, including fire marshals were not trained properly and that the surgery didn't have appropriate measures in place to manage medicines safely. The report adds: "Staff feedback also showed they were unable to speak openly without the fear of retribution. The provider informed us they had policies and processes in place to support staff to raise concerns. A staff satisfaction survey from June highlighted staff were happy and felt supported - which inspectors noted "was not reflected" in their conversations with employees. Spectrum Health also promising to correct the issues highlighted in the CQC report, but challenging the ICB's decision to terminate its contract. It says: "We wish to thank our critical friends at the Care Quality Commission (CQC) for highlighting areas of improvement. As a learning organisation we continuously strive to improve, and the expert guidance from CQC has helped prioritise our attention. "Our practice has experienced more than 10,000 new registrations and we subsequently inherited a high number of new service users who did not have up-to-date medication reviews or high-risk drug monitoring at their previous practice, partly due to the COVID-19 pandemic. The strategic and successful appointment of a full time Clinical Pharmacist and the decision to apply for the closure of our list, was made some months back. "We have also appointed a third-party organisation to help clear the inherited backlog because we understand the importance of such checks. Practices and Hospitals across the nation are working extremely hard to clear a backlog of reviews and operations resulting from the COVID-19 pandemic. "We are also working with NHS stakeholders and reached the very difficult, but joint decision, to reduce our opening hours to 7am – 7pm, Monday to Friday. This will enable us to focus on the required improvements, but it won’t be forever! "In relation an incident that resulted in deleted letters, we can confirm this was human error and these mistakes will always happen within a human industry. However, we can confirm this hasn’t resulted in any harm and a robust audit has taken place where lessons have been learned. "We can also confirm since our new commissioning body, Leicester Leicestershire & Rutland Integrated Commissioning Board, (LLR ICB) which came into existence 3 months ago; has served the practice with a termination notice. We saddened by the ICBs heavy handed approach, which is both punitive and counterintuitive and extremely surprising, considering their primary remit is to support constituent practices and commission services. "We are legally challenging the ICBs decision because they served the notice of termination due to the surgery missing a ‘paper-based’ deadline which was missed due to a technicality outside of our control and shortages of staff. It is unfortunate the ICB does not acknowledge the shortage of GPs and the increasing workload in primary care that led to the unfortunate suicide of a fellow GP in Surrey just a few months ago. One could suggest our governing body has not learnt from the real issues facing General Practice. "The ICB has failed to support us during our period of need and simply advised the practice to produce action plan after action plan when all we needed were real ‘boots on the ground’ and practical support whilst we go through the process of recruiting new staff. Paper-based exercises inevitably diverts frontline workers from patient care, and we would expect the ICB to understand this is the case and provide the real support required. "However, we can now confirm we have recruited one new GP and another GP has returned after being on long-term leave, alongside a cohort of new administrative staff. "We have already received over 4,000 signatories of support from our service users because they know our priority is to deliver safe and effective care. We were first practice to open 7am - 11pm / 7 days a week without additional remuneration and kept our doors open throughout the COVID-19 pandemic which has seen an overwhelming level of support for the services we provide. "We hope the ICB will reconsider their decision and support us to make the required improvements because we know our service users value the service we provide and it would be inappropriate use of resources should we need to take this matter to court." Regarding the bullying accusations against Mr Chadwick, a Spectrum Health spokesperson previously said: "Mr Chadwick denies allegations made and legal proceedings via our solicitor and Leicestershire Police have commenced. Mr Chadwick takes such allegations extremely seriously and therefore ordered an external facilitator to investigate working culture at Spectrum Health. “We can confirm that such allegations are grossly inaccurate and insulting."
