PRIVACY LAWS EXPLAINED

--------------------------------------------------------------------------------

MEET REGULATORY REQUIREMENTS FOR COMPLIANCE

Previous

ICO (UK)

The ICO covers the following laws already enacted: Data Protection Act; General
Data Protection Regulation (GDPR); Freedom of Information Act; Privacy and
Electronic Communications Regulations (PECR); Environmental Information
Regulations

NEVADA PRIVACY LAW (SB-220)

Nevada’s new law, SB-220, which requires website operators to honor opt-out
procedures, went into effect October 1, 2019. Nevada’s Senate Bill 220, or “An
Act relating to Internet privacy,” requires organizations who run websites that
collect and maintain data comply with requirements set by the law.

THAILAND PDPA

Thailand’s Personal Data Protection Act (PDPA) was created to govern data
protection and allow the people of Thailand to exercise their privacy rights.
Thailand’s adoptions of this law were partly inspired by many GDPR principles
and will drastically increase privacy requirements for businesses operating in
Thailand.

BRAZILIAN GENERAL DATA PROTECTION LAW (LGPD)

LGPD was unanimously approved on July 10, 2018 and will become law in 2020. The
LGPD carries many similarities with the EU’s General Data Protection Regulation
(GDPR), however, it is leaner in comparison.

CALIFORNIA CONSUMER PRIVACY ACT (CCPA)

With the CCPA, transparency is key. This regulation went into effect on January
1, 2020 with a 12-month look-back requirement. Because of this, many
organizations are taking measures to ensure their websites are compliant.

GENERAL DATA PROTECTION REGULATION (GDPR)

The big name in privacy, the GDPR sets the most strict and far-reaching
standards for the handling of user data. It is based on principles of consent,
transparency, protection, and user control.

EPRIVACY

The e-Privacy regulation is a law currently being constructed by the EU
Commission. The ePrivacy Regulation compliments the GDPR with a heavier focus on
personal privacy, personal data, and confidentiality, specifically in electronic
communication.

CNIL

In early July 2019, the CNIL updated cookie guidelines that repealed those from
Article 5.3 of the e-Privacy Directive from 2013, which imposed an obligation to
obtain prior consent before placing or accessing cookies and similar
technologies.

HOW CAN YOU MANAGE YOUR PREFERENCES?

Tracking technologies that we enable are an essential part of the frameworks we
have adopted to securely enable our digital ecosystem. Some of these trackers
(which may include third-party cookies) are strictly necessary and are enabled
for security purposes, to technically deliver the website or service requested,
and to facilitate the exercise of other individual rights. Depending on your
choice we may also enable other categories of non-essential trackers to deliver
additional functionalities, such as personalisation, application enhancement or
improved website performance, registering web traffic analysis and, assisting in
our marketing campaigns. The control panel provides detailed information about
each tracker and enables you to opt-in/out of different purposes of processing.
Our systems are able to detect and honour Global Privacy Control. For purposes
of enabling our website and honouring user choice we process user IP addresses.
