NATIONAL RECOGNITION FOR NEW MEXICO'S ELECTION ADMINISTRATION

Over the last few years, New Mexico has been steadily rising in the
Massachusetts Institute of Technology’s (MIT) Election Performance Index. We’re
proud to say we’re now in the top 10! New Mexico scores well on having robust
voter information tools for voters, using post-election audits, efficient
absentee balloting, having below average wait times at polls, and in a number of
other categories.

ELECTION DIVISION UPDATES

NOTICE OF PROPOSED RULEMAKING

The Office of the New Mexico Secretary of State (“Office”) hereby gives notice
that the Office will conduct a public hearing on the new Financial Disclosure
Reporting Procedures rule to be codified as Part 1.10.31 NMAC.

Purpose: The objective of the rule is to establish uniformity in the filing and
enforcement of the financial disclosure act as prescribed by the Financial
Disclosures Act [Chapter 10, Article 16A NMSA 1978].

Date: December 14, 2021, from 9:00 am to 11:00 pm.

Every effort will be made to ensure that this hearing will be live streamed on
the SOS website. 

The public hearing allows members of the public an opportunity to submit data,
testimony, and arguments in person on the proposed rule changes detailed below. 
All comments will be recorded by a court reporter.

CANDIDATE NOMINATING PETITION INFORMATION

The nominating petition forms our Office publishes for use by candidates seeking
a districted office, which must be used by candidates when gathering signatures,
will be delayed due to the delay in Census data being received from the federal
government and redistricting. Approved nominating petition forms for
statewide/non-districted offices will still be made available by our Office on
October 1, 2021.

BUSINESS SERVICES DIVISION UPDATES

IMPORTANT NOTICE

Revised Uniform Law on Notarial Acts (RULONA) is effective on January 1, 2022.

This change in law impacts every current and future commissioned notary public.

All notarial officers will be required to get new official stamps to meet new
legal requirements, keep a mandatory journal of notarial acts, and pass a
training examination before being recommissioned.

The new law also provides for notarial officers to apply with the Secretary of
State to become authorized to perform remote online notarizations.

Names is effective July 1, 2021.  New forms to provide this information are now
available on our website.  Our office will accept the old forms until July 15,
2021.  After this date, Business Services will no longer accept the old forms.
