Changes loom to new pot law

SANDUSKY — Using, possessing and growing marijuana becomes legal on Thursday —
at least if the Republican-dominated Ohio General Assembly doesn’t rush through
proposed changes in the law.

Ohio Gov. Mike DeWine and some GOP lawmakers want to do that, changing a law in
just a few days, with little deliberation, that was approved by 57% of the
voters.

Other lawmakers, such as state Rep. Gary Click, R-Vickery, say that tweaks are
needed but favor a more deliberative approach. And at least some Democrats say
that any major changes in the law should not be rushed through.

Voters in November passed a state law, going into effect Dec. 7, that legalizes
possession of up to 2.5 ounces of weed for adults 21 years old and older, allows
adults to grow up to six cannabis plants at home — with 12 per household if the
home has two adults — and levies a 10% tax, in addition to the usual sales
taxes.

An amendment introduced Monday by Republican senators, added to House Bill 86,
would hike the tax from 10% to 15% and direct that all of the tax revenues go to
the state, with none of the money going to local governments that allow
marijuana dispensaries. The amount of allowed weed possession would be reduced
to one ounce.

News reports said the full Ohio Senate might vote on the measure as early as
Wednesday.

The proposed tax changes are likely to be controversial. Raising taxes sharply
would advantage drug dealers, who of course don’t pay taxes, and would also aid
Michigan marijuana stores, some located just across the Ohio border, by raising
the cost of legal Ohio marijuana. Eliminating revenue for local governments
would remove much of the incentive for allowing such stores.

The leader of Ohio Senate Democrats, Senate Minority Leader Nickie J. Antonio,
D-Lakewood, issued a statement criticizing Republican plans to make changes in
the law.

“A few tweaks to the law may be necessary, but too many of the proposed changes
are egregious and could thwart the will of the people, who voted decisively in
favor of Issue 2,” said Antonio. “I’m hopeful that we can continue to work
together to end up with policy that respects what the people of Ohio voted for.”

Another bill proposed

Last week, Click introduced House Bill 341, a measure to make changes in the
marijuana law. According to the Ohio General Assembly's website, the measure
hasn't been assigned to a committee yet.

Click said the most important part of the bill is the changes it makes in how
revenues raised by the new marijuana tax will be used.

Click’s bill would cut the amount of money sent to a new “cannabis social equity
and jobs fund” from 35% to 19.4%. Distributions to local governments would be
cut from 36% to 19.4%. Funding for substance abuse and education would be cut
from 25% to 19.4%.

Instead, Click’s bill would redirect 19.4% for substance abuse recovery services
and another 19.4% to a law enforcement cannabis training fund. Click's measure
also includes a provision allowing local government to prohibit or restrict
portions of the law.

Click said he is not trying to overturn the new law but is attempting to allow a
measure of local control. He said he opposes allowing local governments to ban
marijuana use.

“Locals may want to restrict areas of consumption. For instance, playgrounds in
city parks, etc. I simply want to give them flexibility while acknowledging the
vote of the people,” he said.

Click said he is attempting to tweak the law, not make radical changes, and
filed an early bill to begin a process of thoughtful conversation about the
bill’s provisions.

“Personally, I have no desire to increase the taxes. If I wanted to do so, that
would have been a simple thing to add in. Ultimately, whatever comes out will
have to be the consequences of both chambers," Click said. "To do that, I think
we will have to show respect for the intent of the voters and ensure that our
changes are in the margins and not in the substance."
