TREASURY MULLS INTERPLAY OF GLOBAL TAX ANTI-ABUSE RULES, LOSSES

 * OECD released anti-abuse guidance in December
 * IRS asked for comment on dual consolidated losses, Pillar Two

The US Treasury Department will consider the OECD’s global minimum tax guidance
and stakeholders’ comments as it develops rules on US dual consolidated losses
and their relation to the 15% levy, a Treasury official said Tuesday

Administrative guidance released by the Organization for Economic Cooperation
and Development Dec. 18 seeks to curb the abuse of certain transactions that
take advantage of differences in accounting and tax treatment to qualify for a
global minimum tax safe harbor. The safe harbor would allow companies to use
their so-called country-by-country reporting information to calculate their tax
rates in each jurisdiction they operate.
