WEST POINT AFFIRMATIVE ACTION

A federal court in New York denied the preliminary injunction requested by
Student for Fair Admissions, whose Supreme Court case against Harvard saw the
high court decide that affirmative action in university admissions is
unconstitutional, in the group’s lawsuit against West Point. The court is not
convinced that the group is likely to succeed on its similar claims against the
military academy due to an incomplete factual record before the court.


CHILD SEXUAL ABUSERS BACK IN COURT

The Ninth Circuit reversed and vacated the dismissals of 11 foreign defendants
in a woman’s lawsuit alleging the companies made, distributed, published and
sold videos of the woman’s childhood sexual abuse on two pornographic websites.
The lower court has specific personal jurisdiction against the foreign entities
because they directed their sites to a U.S. market.




E-CIG MARKETING

The Fifth Circuit granted e-cigarette manufacturers’ petitions for review of the
FDA’s denial of their applications for premarket tobacco approval. The court
said the FDA sent the companies on a regulatory “wild goose chase” before
pretending “it never gave ... instructions” and “imposed new testing
requirements without notice.”




DIABETIC DISCRIMINATION

A federal court in Illinois declined to dismiss a former Chicago Transit
Authority electrician’s disability discrimination claims against the agency,
which plausibly refused to return the diabetic worker to his post for more than
a year after he fainted due to low blood sugar, despite a doctor’s clearance for
him to return to work.


CONSTRUCTION FRAUD FEES

A federal court in Pennsylvania awarded more than $855,000 in attorney fees to
the law firm that successfully won a racketeering lawsuit against firms that,
for years, submitted false invoices on construction projects to defraud
subcontractors, banks and the federal government. The firm put in more than
2,150 hours of work on the case.

SHARK PROTECTIONS

Fishermen will no longer be able to harvest oceanic whitetip sharks in the
Atlantic or hammerhead sharks in the Caribbean once a federal rule goes into
effect Feb. 2. The National Marine Fisheries Service recommended the move to
help safeguard the federally protected species.


FLIGHT MISCONDUCT

A federal judge sentenced a Washington state man to 12 months of home
confinement after he had to be restrained twice on an Alaska Airlines flight in
April 2023. Court documents say he harassed, threatened to kill and assaulted
three different passengers, leading off-duty police officers to restrain him.


GREENWASHING GAS

Two Indian tribes say big oil and gas companies deceptively promote a
clean-energy image, despite knowing for decades that their products cause
irreparable environmental harm.


TEXAS IMMIGRATION LAW

The Justice Department is suing Texas over a new state law set to go into effect
in March that would allow local law enforcement officers to arrest people
suspected of entering the U.S. illegally and also permit state judges to order
the removal of those migrants from the country.


MALL SHOOTING

A woman who was shot at The Cheesecake Factory at the Westfield Southcenter Mall
in Tukwila, Washington, in 2022, and her daughters, are suing the mall claiming
it failed to mitigate the “rampant crime and violence” on its premises.
