COURT ORDERED NOTICE OF CLASS ACTION SETTLEMENT

IF YOU WERE ASSESSED A RELEVANT FEE BY MCCOY FEDERAL CREDIT UNION, YOU COULD GET
A PAYMENT FROM A CLASS ACTION SETTLEMENT.

 1. The settlement provides $1,000,000 (the “Settlement Fund”) in payments or
    account credits and $400,000.00 in Debt Forgiveness, to settle claims
    relating to certain fees (defined in footnote 1 below) that McCoy Federal
    Credit Union (“Defendant”) charged between January 28, 2016, and June 30,
    2021.

 2. Class Members who do nothing will automatically receive a check, account
    credit, and/or debt forgiveness. These payments and credits will be from the
    Net Settlement Fund based on a percentage of the amount of applicable fees
    paid. The amount of these payments will be determined by an independent
    settlement administrator and not by Defendant. You are a Class Member if the
    noticewas addressed to you.

 3. Your legal rights are affected, so please read the notice carefully.

    YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT:
    
    DO NOTHING
    
    Automatically receive a settlement check or account credit or debt
    forgiveness once the settlement is finally approved. Give up the right to
    bring a separate lawsuit about the same issue.
    
    EXCLUDE YOURSELF
    
    Get no benefits from the settlement. Keep the right to bring a separate
    lawsuit about the same issue at your own expense.
    
    OBJECT
    
    Write to the Court about why you don’t like the settlement. If the
    settlement is approved, you will still automatically receive a check or
    account credit or debt forgiveness and give up the right to bring a separate
    lawsuit about the same issue.

 4. [1] “Relevant Fees” means the fees complained of in the Complaint, namely
    overdraft fees charged by Defendant during the Class Period on debit card
    transactions that were initiated when the customer’s account contained a
    positive available balance sufficient to cover the transaction, but which
    later settled into a negative account balance and Non-sufficient Funds
    (“NSF”) Fees assessed on second or third presentments of a check or ACH
    transaction.

 5. These rights and options—and the deadlines to exercise them—are explained in
    the notice.

 6. Please be patient while the Court decides whether to approve the settlement.
