  <p style="text-align: justify;">The Dubai International Arbitration Centre (DIAC) and the London Court of International Arbitration (LCIA) are pleased to announce that they have agreed terms consistent with Decree No. (34) of 2021 of the Government
    of Dubai by which the LCIA will administer all existing DIFC-LCIA cases (i.e. those commenced and registered by the DIFC-LCIA under a designated case number on or before 20 March 2022) from London. The DIAC and the LCIA have agreed a mechanism
    for the orderly management of funds paid by parties into bank accounts previously held on behalf of DIFC-LCIA and now owned by DIAC, pursuant to which the DIAC shall transfer such casework related payments to the LCIA to be disbursed to the
    respective beneficiaries by the LCIA directly. The LCIA will communicate with parties and tribunals as soon as practicable. All enquiries regarding cases commenced and formally registered on or before 20 March 2022 should be emailed to:

  <p>All arbitrations, mediations and other alternative dispute resolution proceedings referring to the respective rules of the DIFC-LCIA, including ad hoc proceedings where the DIFC-LCIA is requested to act as appointing authority or administrator,
    commenced on or after 21 March 2022 (or commenced before 21 March 2022 but not registered by the DIFC-LCIA under a designated case number) shall be registered by DIAC and administered directly by its administrative body in accordance with the
    respective rules of procedure of DIAC, including the tables of fees and costs in force from time to time, through DIAC’s own case management systems, unless otherwise agreed by the parties. Payments made by the parties to arbitration in respect

  <p style="text-align: justify;">On 20 September 2021, Decree 34 of 2021 Concerning the Dubai International Arbitration Centre (DIAC) was enacted in Dubai, by virtue of which the Arbitration Institute in the DIFC (DAI) was abolished and its assets
    transferred to DIAC. DAI was the LCIA's counterparty to an Operating Agreement that established the DIFC-LCIA.<br>
    <br> This Decree and its swift enactment came as a surprise to the LCIA. The LCIA was not consulted nor given notice of the Decree. As recently as April 2021, with the enactment of Law No. 5 of 2021 in respect of the Dubai International Financial
    Centre (referred to as the "Founding Law"), the DAI was reconstituted in a way that was consistent with maintaining the joint venture with the LCIA. The LCIA was fully expecting the Operating Agreement to be renewed and the arrangements
    previously in place to continue.<br>
    <br> The Decree states that all agreements providing for arbitration at the DIFC-LCIA, which have been concluded by the date of entry into force of the Decree, shall be considered valid and effective. It also provides that DIAC shall substitute
    the DIFC-LCIA in the hearing and settlement of the disputes arising out of such agreements, unless the parties agree otherwise. The Decree also provides for a transition period of six months.<br>
    <br> The LCIA has been in discussion with the authorities in Dubai regarding such transition period and to seek to ensure the continuing good management of existing and future cases where parties have agreed in their contract to arbitration or
    mediation pursuant to the DIFC-LCIA Rules.<br>
    <br> The DIFC has on 7 October 2021 issued a press release stipulating that existing cases will continue to be administered by the DIFC-LCIA casework team and the LCIA. However, all arbitrations, mediations and other ADR proceedings arising out
    of agreements referencing the DIFC-LCIA referred for resolution after the date of the enactment of the Decree will be administered by DIAC in accordance with the DIAC Rules, unless the parties thereto agree otherwise.<br>
    <br> Outstanding questions which must be resolved as a matter of urgency include the current status of the DIFC-LCIA casework team, their ability to access the funds held by DAI on behalf of the parties to existing DIFC-LCIA cases and the way in
    which the authorities intend to equip DIAC to perform its new functions.<br>
    <br> The immediate priority of the DIFC-LCIA casework team, under the supervision of the LCIA Court, has been to address the day-to-day management of cases referred to the DIFC-LCIA prior to the enactment of the Decree.<br>
    <br> The LCIA is available to respond to queries from parties regarding existing or future arbitration agreements. The parties may agree to refer future disputes to the LCIA.
