The Real Investigation into the San Bruno Explosion
The case against PG & E and the California Public Utilities Commission [CPUC],
in the matter of suppressing the investigation into the San Bruno explosion.

Earth Constitution

 

PREAMBLE

At present, the world needs justice, liberty, and sustainable living in response
to both privatized and State-sponsored crimes against humanity, such as the
innumerable actions of both government and private institutions that promote
perpetual war and exploitation of the natural environment.

We see our shared planet suffers today, especially as monetary systems around
the world lack inherent mechanisms to place environmental ethics in balance with
human needs and desires. The ethics of raw commerce and competition are
routinely incompatible with natural resource protection. And in the face of
dense and demanding human populations, much of our suffering comes from an
ever-spiraling material accumulation of human products that are shamefully
counter-productive to achieving a high standard of living. By way of both common
experience and professional research, mankind is beginning to appreciate the
reality that peaceful and environmentally holistic lifestyles are desirable for
mankind in general. 

As numerous treaties evidence, our shared goals involve populations living in
harmony with their surroundings, and enjoying properly scaled production and
waste management. In short, stewardship of the natural environment is a great
shared value and virtue that monetary systems must find a way to inherently
recognize.

For better or worse, our human history has shown that the long-term exploitation
of the earth by large-scale industrialization processes and consumer-based
economies is not sustainable. We the people are generally in agreement regarding
this observation in our world, just as we are scarcely amazed anymore to find
vast sums of money/debt in the world concentrated toward a small percentage of
people, amorphously referred to by many as the ‘investor-class’ or even ‘the
elite’. The people have spoken that they do not feel ‘represented’ by this
investor class primarily because time has shown that both the few and their
money lack the wherewithal or skills to correct widespread imbalances of poverty
and environmental degradation. Likewise, the majority of the world’s people are
disengaged and under-informed participants in an amorphous ‘consumer class’, a
class or series of classes that also proves by virtue of time to lack the
wherewithal to use purchasing power responsibly in favor of environmental
preservation and economic sustainability. A mandatory ethical solution is
needed, along with firm leadership that is both politically acceptable and fair
in the long-term.

Accordingly, this Constitution for the planet is presented in the name of reason
and fairness to help promote our common ethical values. It is imperfect, but it
moves in the general direction we desire as a world community, especially as we
desire to ensure the cost of pollution is built into free market equations that
are already successfully beyond the control of any man or government.

We acknowledge the rampant pollution in our world today provides us with unique
engineering and economic opportunities, such that we are invited to build entire
new economies around our skills and desires for environmental remediation,
sustainability enterprises, and peaceful service. We now step forward to work
toward these ideals.

 

ARTICLES

Article One.

Section 1. The United Nations is hereby abolished, and its authority to work
justice is transferred to a new governing authority with jurisdiction across
earth, which shall be called Earth Government. The individual humans of the
world hold and maintain legislative authority over the Earth Government. 


Section 2. Before any text or action may become a law from Earth Government, a
majority of eligible voters of the world must cast a vote in favor of the matter
becoming law. A regulation is not a law, but rather an expression of law, so
this section shall not hinder the regular enactment of necessary, appropriate,
and binding regulations to enforce law consistent with this Constitution.

Section 3. Any human may publicly designate in writing any other consenting
human as a representative able to cast any vote, and this designation may be
publicly withdrawn in writing at any time. With the exception of minors under
the age of sixteen years, and those properly adjudged legally unfit to vote, all
humans shall have equal voting rights on matters relating to Earth Government.


Section 4. For the election of an individual, to an office required by this
Constitution, the recipient of the highest number of votes cast by eligible
voters shall have the first right to hold the office.  However, to impeach an
individual from office will require that fifty-one percent of all individuals
eligible to vote actually do vote in favor of impeachment.

Section 5. Legitimate votes must be hand-written on paper and affirmed by
signature of the voter, and then counted by hand under the supervision of the
Article III Judiciary. The intentional and unjustifiable suppression of
another’s vote shall be a crime.


Section 6. Any amendments of this Constitution shall require the three-fourths
approval among all individuals eligible to vote.

 

Article Two.


Section 1. The executive power of Earth Government shall be vested in a Chief
Caretaker. The Chief Caretaker shall hold office for a term of four-years. Votes
to elect an executive may be submitted at anytime during Spring of the
appropriate year in the 4-year cycle.

Section 2. The Chief Caretaker shall publish all Earth Government laws in the
languages used by the Nations.


Section 3. The Chief Caretaker shall have reasonable and cooperative discretion
to withdraw money from the Article IV Treasury of the Earth Government to
discharge the duties of the Chief Caretaker required by this Constitution. 

Section 4. The Chief Caretaker’s personal salary is one hundred ounces of gold
or equivalent per year.


Section 5. The Chief Caretaker shall publish a written list of successors in the
event of incapacity during the elected 4-year term.

Section 6. The Chief Caretaker may issue executive orders to bind the agencies
of the executive branch that the Chief chooses to maintain.


Section 7. The Chief Caretaker’s primary responsibilities include the
enforcement of Earth Government’s laws to achieve justice, service as the head
of State in international matters, and service as Commander in Chief of the
military.

 

Article Three.


Section 1. The judicial power for the Earth Government shall be vested in one
Supreme Court, operating above seven regional courts. Each continent represents
its own region.

Section 2. Each Supreme Court shall have twelve judges, each elected for a
ten-year term. Votes to elect a judge may be submitted at anytime during
November of the appropriate year in the ten-year cycle. The Executive for the
jurisdiction shall appoint one of the Supreme Court judges to the position of
Chief Judge. This Chief Judge shall issue binding rules for internal
administrative efficiency of the Judiciary, and such rules yield to the rights
of individuals.


Section 3. The Chief Judge shall assign a Supreme Court judge for each of the
regional courts for the purpose of appointing judges at the regional level to
ten-year terms, and issuing binding rules for internal administrative efficiency
of the regional courts, and such rules yield to the rights of individuals. 

Section 4. The Earth Government judicial power shall extend to all law
enforcement matters.


Section 5. Supreme Courts maintain appellate jurisdiction, while regional courts
maintain original and appellate jurisdiction. 

Section 6. Each Supreme Court shall conduct a yearly census to determine with
reasonable accuracy the number of eligible voters in its jurisdiction.


Section 7. Each Supreme Court shall maintain a library for the storage of
official records of laws.

Section 8. The personal salary of an elected judicial officer is one hundred
ounces of gold or equivalent per year.


Section 9. The Chief Judge shall have reasonable and cooperative discretion to
withdraw money from the Treasury of the Earth Government to discharge the duties
of the Judiciary required by this Constitution.

Section 10. The judiciary’s primary responsibilities are maintaining courts for
the enforcement of law and the resolution of disputes, verifying the legitimacy
of votes, and verifying the accuracy of all matters that must be published
pursuant to this Constitution.


Section 11. Citizen courts and militia shall not be construed as law enforcement
authorities, but rather as impermissible vigilantes. However, this section shall
not limit the right of the individual to exercise reasonable self-defense.

 

Article Four.


Section 1. The financial administration of the Earth Government shall be
maintained by one Treasury of the Earth Government.

Section 2. The Treasury shall have twelve Treasury Officers, each elected for a
ten-year term. Votes to elect a Treasury Officer may be submitted at anytime
during Spring of the appropriate year in the ten-year cycle. The Executive may
appoint one of the Treasury Officers to the position of Chief Treasury
Officer. This Officer shall issue binding rules for internal administrative
efficiency of the Treasury, except that such rules yield to the rights of
individuals.


Section 3. Each Treasury shall levy and collect the taxes described in this
Constitution.

Section 4. The Treasury shall establish and maintain an earth currency
redeemable in gold, silver, and organic commodity. 


Section 5. The Treasury shall immediately make a one-time issuance of
constitutional dollars denominated in one hundred dollar certificates. Every
human alive at the time of issuance shall immediately receive seven thousand
constitutional dollars.

Section 6. The Chief Treasury Officer shall have reasonable discretion to sell
any assets belonging to the former United Nations, excluding land and natural
resources, military surplus, or weapons-grade material.


Section 7. No money shall be drawn from the Treasury but in consequence of
appropriations made by law. An ongoing accounting of the receipts and
expenditures of all public money shall be maintained publicly.

Section 8. The personal salary of an elected Treasury Officer is one hundred
ounces of gold or equivalent per year.


Section 9. The Chief Treasury Officer shall have reasonable and cooperative
discretion to withdraw money from the Treasury to discharge the duties of the
Treasury required by this Constitution.

Section 10. Nothing in this Article shall limit the right of the people to issue
uniquely faced currency.

 

Article Five.

Section. 1. Any elected official, or non-elected official working as an agent of
an elected official, who maliciously violates this Constitution shall be guilty
of the crime of treason, and thereby automatically divested of their authority.

Section 2. Within the limitations of logic and fairness, words utilized to
convey the law should carry their ordinary meaning. Isolated political or legal
phrases and words are disfavored to describe the scope or meaning of law or
regulation. Instead, the force of law relies upon descriptive and relevant
examples, including but not limited to examples from previously decided cases,
concerning the objective sensory experiences of people, and the physical nature
of things and concepts at issue. 

Section 3. No law or contract shall require advocacy or confidentiality. In
every moment such matters are voluntary and reserved to the personal
responsibility decisions of individuals.

 

Article Six.

Section 1. All debts contracted and engagements entered into by the former
United Nations before the adoption of this Constitution shall not be binding on
Earth Government created under this Constitution, and likewise, all debts owed
to the former United Nations are hereby forgiven. This section shall not apply
to criminal penalty or incarceration, except to the extent of prison reform laws
enacted via Article I.

Section 2. This Constitution shall be considered the law and social contract of
the planet and must be adhered to by the authorities in every Nation and State,
except in cases where a twelve-person jury, after a trial by due process of law,
elects to issue judgment by a natural law or by conscience.

Section 3. All authorities with territorial jurisdiction have the right to
enforce applicable laws and regulations. The Earth Government has full
territorial jurisdiction across the planet, and the most senior right of law
enforcement. Authorities who share territorial jurisdiction over a matter
requiring law enforcement shall cooperate to distribute enforcement powers
amongst themselves. Senior law enforcement authorities shall receive the
enforcement file and collected evidence on a matter upon reasonable request
issued in writing by the senior Executive. Where the law enforcement matter
requires enforcement against a governmental authority, then jurisdiction shall
reside with the most senior authority with jurisdiction that is unaffected by
the suspected violation.

Section 4. The only absolute right of the individual is to be peacefully
natural, which is a manner of being that causes no actual material or unjust
harm, or individually calculable material and unjust threat, to another living
being and which is a fundamental expression of the individual human condition.
Accordingly, a law or regulation is unenforceable to the extent it would
infringe upon the right to be peacefully natural. All other rights are
qualified, so all laws and regulations, including the laws in this Constitution,
are subject to reasonable balancing between the extent of individual rights and
the extent of the police power.

Section 5. The validity of all law enforcement comes from the police power,
which promotes the material safety of individuals and community, and the orderly
administration of governmental law enforcement. A fundamental role of the
Judiciary is to maintain checks and balances over the Executive in its
enforcement of law and regulation.  Otherwise valid laws may not be rendered
void for unconstitutional vagueness on the grounds that simplicity or brevity in
law may lead to unequal or arbitrary enforcement.

 

Article Seven.

Section 1. Toward the goal of respecting our Creator in heaven, the lawful and
traditional Nation of Israel remains fully sovereign, and the King of Israel may
choose whether to comply with this Constitution at any given time and space.

Section 2. Individuals living their absolute right to be peacefully natural
remain fully sovereign and may choose whether to comply with this Constitution
at any given time and space.

 

Article Eight.

Section 1. Earth Government shall make no law respecting an establishment of
religion, or prohibiting the free exercise thereof; or abridging the freedom of
speech, or of the press; or the right of the people peaceably to assemble, and
to petition the Earth Government for a redress of grievances.

Section 2. The right of the people to keep and bear arms for reasonable personal
and family protection, and to promote a well-regulated militia, shall not be
infringed.

Section 3. No soldier shall, in time of peace be quartered in any house, without
the consent of the owner, nor in time of war, but in a manner to be prescribed
by law.

Section 4. The right of the people to be secure in their persons, houses,
papers, and effects, against unreasonable searches and seizures, shall not be
violated, and no warrants shall issue, but upon probable cause, supported by
credible evidence, and particularly describing the place to be searched, and the
persons or things to be seized.

Section 5. No person shall be held to answer for a capital crime, unless on a
presentment or indictment of a grand jury; nor shall any person be subject for
the same offense to be twice put in jeopardy of life or limb; nor shall be
compelled in any criminal case to be a witness against himself, nor be deprived
of life, liberty, or property, without due process of law; nor shall private
property be taken for public use, without just compensation.

Section 6. In all criminal prosecutions, the accused shall enjoy the right to a
speedy and public trial, by an impartial jury where the crime was allegedly
committed, and to be informed of the nature and cause of the accusation; to be
confronted with the witnesses against him; to have reasonable compulsory process
for obtaining witnesses in his favor, and to have the assistance of counsel for
his defense.

Section 7. In suits upon civil law, the right of trial by jury shall be
preserved, and no fact tried by a jury shall be otherwise re-examined, in any
court, than according to the rules of the civil law.

Section 8. Excessive bail shall not be required, nor excessive fines imposed,
nor cruel and unusual punishments inflicted.

Section 9. The enumeration in the Constitution, of certain rights, shall not be
construed to deny or disparage others retained by the people and their local
governments and Nations.

Section 10. The powers not delegated to the Earth Government by the Constitution
are reserved to the Nations respectively, or to the people or their local
governments.

Section 11. The right of individuals to vote in any election shall not be denied
or abridged by reason of failure to pay any government fee or tax.

Section 12. Equality of rights under the law shall not be unfairly denied,
abridged, or apportioned, on account of a physical trait, political affiliation,
or ideological position.

Section 13. Neither slavery nor involuntary servitude, except as a punishment
for crime whereof the party shall have been duly convicted, shall exist on this
planet.

Section 14. All persons born or naturalized on the planet are citizens of the
Earth and of the Nation wherein they reside.

Section 15. It shall be the burden and responsibility of governments, including
the Earth Government, to identify individuals. Governments may not require or
force any individual to provide personal or other identifying information
without a lawfully obtained warrant specific to that individual. Nor may
government require or force any individual to possess or present any form of
identification, except as provided by a law specifically requiring
identification in order for that individual to consensually receive a government
benefit, consensually participate in some government function, or to perform an
act requiring licensure under the law because it is unnatural.

Section 16. Intelligent extraterrestrial individuals may become citizens of the
Earth by birth within the territorial borders of the Earth, adoption or
long-term acceptance into the family and home of any citizen of the Earth,
status as a political refugee recognized by the President upon arrival to the
Earth, or by work visa as the President may issue by the discretion of the
Executive branch. Citizenship among the Nations is determined by a citizen’s
domicile. The Chief Caretaker and Earth Government Judiciary shall have the
power to regulate citizenship and the Earth’s territorial integrity, including
by intergalactic cooperation in matters of law enforcement, to ensure that
individuals entering the Earth are not fleeing justice.

Section 17. The writ of habeas corpus shall not be suspended.

Section 18. There shall be no judgment without trial.

Section 19. No retroactive laws shall be passed.

Section 20. For jurisdictional purposes, the present geographical boundaries of
governmental and law enforcement authorities in this land shall be retained.

Section 21. The following codes attached to this Constitution shall apply to all
jurisdictions on Earth as legislation passed pursuant to Article I, and where
necessary shall replace or supersede conflicting laws presently in effect in the
Nations:

Article Nine.

Section 1. This Constitution shall be ratified upon a majority of eligible
voters casting a vote in favor. Votes shall be compiled, counted, and verified
by the Nations in a worldwide constitutional convention.

Section 2. In order to maintain law and order and environmental stewardship
across this planet, upon enactment of this new Constitution, the Chief Caretaker
shall support and maintain necessary functions of necessary departments and
installations of the United Nations in order to safely phase into full operation
of the new Constitutional government.

Section 3. The mechanics of the transition should focus first on effectively
dismantling the tools of the military-industrial complex, including but not
limited to advanced weaponry and bioengineered materials and organisms
threatening ecosystems. Existing Environmental Protection Agencies shall act
under the direction of their government’s Executives, and they shall take the
lead in supervising existing necessary personnel with the peaceful operation and
dismantling of dangerous installations.

Section 4. The new Chief Caretaker shall provide significant advance public
notice describing in detail his short and long-term plans to phase-in the new
government, and to phase-out old systems. He shall report regularly to the
public on his progress.  He shall maintain thorough visibility into his
government, such that he must disclose the existence of all projects and
installations, though he may withhold technical details on the precise mechanics
of the operation and dismantling of dangerous materials when it serves the
interests of public safety. During this transition, his executive discretion
shall be on par with the letter of law, and subject to judicial review. It shall
be the duty of the Chief Caretaker and each Nation’s Executive to declare
publicly when transitions are effectively complete.

Preamble

To assist the needy, the Executive of the Federal Government and each State
shall manage a Social Welfare Department with general funds and any private
donations, which shall operate (1) farms, (2) shelters, (3) orphanages, and (4)
an adoption and foster care program.




Article I. Farm Program


Section 1. The Executive shall appoint a Farm Program Administrator to manage
the day-to-day operations of this Program.

Section 2. The Administration shall have discretion to issue standards,
procedures, and decisions for all aspects of program administration.

Section 3. Farms must be small, eco-friendly, polyculture farms open to the
public for daily living.

Section 4. Farm administration retains discretion to balance farm resources
between the mutual goals of support, safety, and education. This should include
working with, and teaching, the needy to produce food, drinking water, natural
remedies, clothes, shelter, and other natural products for their daily living.

Section 5. Farm administration retains discretion for safety purposes to
segregate any individual or individuals, except immediate family members who
mutually and without coercion wish to live together on the farm. Farm
administrators also retain discretion for safety purposes to remove any
individual from the premises.

Section 6. The government shall be immune from liability for harm incurred on
any farm, except in cases of malicious actions taken by a government employee or
agent.




Article II. Shelter Program


Section 7. The Executive shall appoint a Shelter Program Administrator to manage
the day-to-day operations of this Program.

Section 8. The Administration shall have discretion to issue standards,
procedures, and decisions for all aspects of program administration.

Section 9. Shelters shall consist of basic eco-friendly housing, for subsistence
purposes, open to the public. Shelter administration services shall make
available organic food, drinking water, natural remedies, clothes, and other
natural products for the daily living needs of the residents.

Section 10. Shelter administration retains discretion to balance resources
between the mutual goals of support, safety, education, and managing capacity.

Section 11. Shelter administration also retains discretion for safety purposes
to segregate any individual or individuals, except immediate family members who

to segregate any individual or individuals, except immediate family members who
mutually and without coercion wish to live together. Orphanage administration

Article IV. Adoption and Foster Care Program


Section 17. The Executive shall appoint an Adoption and Foster Care Program
Administrator to manage the day-to-day operations of this Program.

but not limited to eligibility of participants, review of participant progress,
and compensation for participants.

Section 19.At the same time the Administration respects the privacy and parental
judgment of participants, the Administration shall give preference for foster
and adoptive parents and families who demonstrate the following attributes:
a. Favored by the foster or adoptive child
b. Maintains good standing in family, social, and professional networks
c. No criminal record or reasonable suspicion of criminal activity of any kind
d. Not perceived by government personnel, using their common-sense and
experience, to be a risk to others for violence or sexual molestation
e. Practices fiscal responsibility
f. Demonstrates personal responsibility, personal accountability, and respect
for the individual rights of others
g. Maintains a healthy lifestyle
h. Uses the same language as the foster or adoptive child
i. Family has children of similar age to the foster or adoptive child




Article V. Social Welfare Department Administration


Section 20.For employee selection purposes, Administrators shall give
substantial weight to the following criteria:

a. Maintains good standing in family, social, and professional networks
b. No criminal record or reasonable suspicion of criminal activity of any kind
c. Not perceived by government personnel, using their common-sense and
experience, to be a risk to others for violence or sexual molestation
d. Practices fiscal responsibility
e. Demonstrates personal responsibility, personal accountability, and respect
for the individual rights of others
f. Maintains a healthy lifestyle

Section 21.Employment decisions of Administrators may not be challenged with
allegations such as failure to hire and wrongful termination.




Article VI. Definitions


Section 22. The term "immediate family members" means parents, siblings,
children, grandparents, cousins, aunts, uncles, or any relative who has
cohabited for an extended period of time.

Section 23.The term "mutually and without coercion wish to live together" shall
not apply to the following instances: (a) on a short-term basis where a senior
administration official independently determines, and makes a written record of
the credible evidence, that one of the family members has been improperly
coerced or threatened with harm to support their election to live together; or
(b) on a long-term basis following a judgment based upon credible evidence, that
one of the family members has been improperly coerced or threatened with harm to
support their election to live together.

research is a careful study to help separate propaganda from truth.
