NYC PROTECTIONS FOR FAST-FOOD WORKERS UPHELD BY SECOND CIRCUIT

Restaurant industry groups challenging a New York City law protecting fast-food
workers from arbitrary firings and reduced hours failed to convince a federal
appellate court in Manhattan to strike down the employee protections on Friday.

The city law isn’t preempted by the National Labor Relations Act, and it doesn’t
run afoul of the US Constitution’s dormant commerce clause, the US Court of
Appeals for the Second Circuit said, rejecting the arguments of the Restaurant
Law Center and the New York State Restaurant Association.
