The city law isn’t preempted by the National Labor Relations Act, and it doesn’t run afoul of the US Constitution’s dormant commerce clause, the US Court of Appeals for the Second Circuit said, rejecting the arguments of the Restaurant Law Center and the New York State Restaurant Association.
