The paper looks first at different answers that could be given to the question
of what constitutes a civilian perspective. It goes on to ask whether a civilian
might have a different understanding of the domain of private law than many of
those who work in what is sometimes called, in the English-speaking world,
private law theory. In the last three decades, Europe has seen a remarkable
proliferation of collective action legislation, making class actions the most
successful export product of the American legal scholarship. While its spread
has been surrounded by distrust and suspiciousness, today more than half of the
EU Member States have introduced collective actions for damages and from those
who did, more than half chose, to some extent, the opt-out system.


ABOUT THE GOALS OF PRIVATE LAW

This book demonstrates why collective actions have been felt needed from the
perspective of access to justice and effectiveness of law, the European debate
and the deep layers of the European reaction and resistance, revealing how the
Copernican turn of class actions questions the fundamentals of the European
thinking about market and public interest. Using a transsystemic presentation of
the European national models, it analyzes the way collective actions were
accommodated with the European regulatory environment, the novel and peculiar
regulatory questions they had to address and how and why they work differently
on this side of the Atlantic.

Comparative law is generally understood as involving the comparison of
contemporary legal systems in different countries. These lectures will be an
experiment in a different kind of comparative law, a comparison over time
between two systems operating within the same country at a distance of nearly
half a millennium.

The past is not a wholly different country. The common law is still, in an

   fori, punitive damages have been found to be in breach of public policy by

   with the analytical table of legal relationships propounded by the American
   jurist Wesley Hohfeld, one of the eight positions in the table is that of the
   no-right.

   

   Doubtless, one reason for the relative dearth of scrutiny is that Hohfeld
   devised a hyphenated neologism to designate no-rights. Moreover, on the
   rather rare occasions when the term is used rather than merely mentioned, it
   is almost always misused. The exploration of the correct use of that term in
   the first half of this paper may seem rather fussy, but the importance of
   that exploration for a satisfactory understanding of legal and moral
   relationships will become apparent in the second half of the paper.
