CLIENT ALERT: MIND YOUR PS AND QS, AND YOUR PTAS TOO

On August 28, 2023, the Federal Circuit held that obviousness-type double
patenting (ODP) trumps patent term adjustment (PTA), opening the door for
invalidity attacks that to date had been questionable. In re Cellect was an
appeal from a PTAB decision affirming a patent examiner's finding that claims
across four patents owned by Cellect LLC were unpatentable because of
obviousness-type double patenting.

NEWMAN ISSUES FED. CIRC. DECISION AFFIRMING ROKU PTAB WINS

Sterne Kessler secured a win for client Roku at the Federal Circuit, as reported
by Law360 in the article “Newman Issues Fed. Circ. Decision Affirming Roku PTAB
Wins.” The court affirmed PTAB decisions that invalidated claims in remote
control configuration software patents held by Universal Electronics. Directors
Jon Wright and Lestin Kenton and Counsel Richard Crudo represented Roku.
