2ND.MD 2024 SGA CAMPAIGN 4 SWEEPSTAKES OFFICIAL RULES


1. HOW TO ENTER: NO PURCHASE OR INTERNET ACCESS NECESSARY. A PURCHASE WILL NOT
INCREASE YOUR CHANCES OF WINNING.

2nd.MD (the “Company”) Sweepstakes (“Sweepstakes”) begins at 12:00am ET on
August 01, 2024 and ends at 11:59pm ET on September 30, 2024 (“Entry Period”).
To enter, you must activate your 2nd.MD account during the Entry Period. You may
activate your 2nd.MD account in one of the following ways: online (visit
2nd.MD/activate, answer all questions and click submit), by phone (call
1-866-841-2575) or mailing in your information by the end of the Entry Period.
To enter via mail, please mail your entry, which includes your name, email and
phone number to: 2nd.MD, Attn: GA 4 - 2024 Sweepstakes Entry, 9655 Katy Freeway,
Suite 300, Houston, Texas 77024. Your entry must be completed and received by
the Company by September 30, 2024. Limit one entry per person. Incomplete
entries are void. The Company assumes no responsibility for lost, late,
misdirected, illegible or mutilated entries or for any computer, online,
telephone, cable, network, electronic or Internet hardware or software
malfunctions, failures, connections, availability, garbled or jumbled
transmissions, service provider, Internet, web site, or other accessibility or
availability issues, traffic congestion, or unauthorized human intervention, or
any technical malfunctions that may occur. Entrants shall be the authorized
account holder of the email address submitted at the time of entry. “Authorized
account holder” is defined as the natural person who is assigned to an e-mail
address by an Internet access provider, online service provider, or other
organization (e.g., business, educational institution, etc.) that is responsible
for assigning e-mail addresses for the domain name associated with the submitted
e-mail address.




2: ELIGIBILITY:

This Sweepstakes is open only to legal residents of the U.S. (excluding Puerto
Rico) who are 18 years of age or older as of the date the Sweepstakes begins,
who are also eligible participants in the Company’s services offered by your
Employer. Employees of the Company, their subsidiaries, affiliates, prize
suppliers, and advertising and promotional agencies of the Company, and their
immediate families (spouse, parents, children, siblings and their spouses) and
individuals living in the same household as such employees are ineligible. This
Sweepstakes is governed by the laws of the United States and is subject to all
applicable federal, state, and local laws and regulations. Void in Puerto Rico
and where prohibited.




3. JUDGING:

Winners will be selected by random drawing on or about October 15, 2024 from
among all eligible entries received. All prize drawings will be conducted at the
Company’s offices, located at 9655 Katy Freeway, Suite 300, Houston, Texas
77024. By participating, entrants agree to be bound by these Official Rules.
Odds of winning depend on the total number of eligible entries received.
Winner(s) will be notified via email, U.S. mail, telephone, and/or by overnight
courier.




4. PRIZES:

There will be 2 winners selected and a VISA Gift Card granted. The value of the
prize is approximately $500. The prize cannot be exchanged for cash, and cannot
be used in conjunction with any other promotion. the Company reserves the right
to substitute a prize of equal or greater value in the event the offered prize
is unavailable. No substitution or transfer of prize permitted except as
provided herein.




5. GENERAL CONDITIONS:

All federal, state, and local taxes, fees and surcharges on prize packages are
the sole responsibility of the prize winners. Return of any prize and/or prize
notification as undeliverable or failure of any entrant to comply with any
Official Rules will result in disqualification and selection of an alternate
winner. Winners grant Company the right to use and publish their legal name and
state of residence online and in print, or any other media, in connection with
the Sweepstakes. Except winners who are residents of the State of Tennessee,
acceptance of a prize constitutes permission for Company and their advertising
and promotional agencies to use winners’ names and likenesses for editorials,
advertising and promotional purposes without payment of additional compensation
unless prohibited by law. By entering, participants release and hold harmless
the Company, their respective parents, subsidiaries, affiliates, directors,
officers, employees, attorneys, agents and representatives from any and all
liability for any injuries, loss, claim, action, demand or damage of any kind
arising from or in connection with the Sweepstakes or any prize won, any misuse
or malfunction of any prize awarded, participation in any Sweepstakes related
activity, or participation in the Sweepstakes. As a condition of participating
in this Sweepstakes, participant agrees that any and all disputes which cannot
be resolved between the parties, and causes of action arising out of or
connected with this Sweepstakes shall be resolved individually, without resort
to any form of class action, exclusively, before a court of competent
jurisdiction located in Houston, Texas, which court shall apply the laws of the
state of Texas without regard for rules of conflicts of law. In any such
dispute, participant shall, under no circumstances, be entitled to claim
punitive, incidental, or consequential damages, or any other damages, including
attorneys’ fees, other than participant’s actual out-of-pocket expenses (if any)
associated with participating in the Sweepstakes, and participant hereby waives
all rights to have damages multiplied or increased.


6. ADDITIONAL TERMS:

2nd.MD reserves the right to modify or cancel a Sweepstakes at any time. 2nd.MD
is not responsible for: (a) lost, misdirected, late, incomplete, or
unintelligible entries or for inaccurate entry information, whether caused by
you or by any of the equipment or programming associated with or utilized in a
Sweepstakes, or by any technical or human error that may occur in the processing
of entries; (b) any printing or typographical errors in any materials associated
with a Sweepstakes; (c) any error in the operation or transmission, theft,
destruction, unauthorized access to, or alteration of, entries, or for
technical, network, telephone, computer, hardware or software, malfunctions of
any kind, or inaccurate transmission of, or failure to receive any entry
information on account of technical problems or traffic congestion on the
Internet or at any website; or (d) injury or damage to your or any other
computer or device resulting from downloading any materials in connection with a
Sweepstakes. 2nd.MD may, in its sole discretion, disqualify any individual found
to be: (x) tampering with the entry process or the operation of a Sweepstakes or
website; (y) acting in violation of these rules; or (z) acting in an
unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or
harass any other person. If your entry is incomplete or if you use robotic,
automatic, programmed or similar entry methods, your entry will be disqualified.
The authorized subscriber of the e-mail account used to enter a Sweepstakes at
the actual time of entry will be deemed to be the participant and must comply
with these rules in the event of a dispute as to entries submitted by multiple
users having the same e-mail account. The authorized account subscriber is the
natural person who is assigned an e-mail address by an Internet access provider,
on-line service provider, or other organization responsible for assigning e-mail
addresses for the domains associated with the submitted e-mail addresses. No
greater than the 1 of the prize stated will be awarded, and if the prize is not
claimed seventy-two (72) business day hours after the end date of the
Sweepstakes Period, the prize may not be awarded and such prize may be
forfeited. If any technical or other errors occur in the selection of a
potential winner, 2nd.MD may award the prize(s) by random drawing from among all
eligible claimants.




7. CHOICE OF LAW AND JURISDICTION:

Except where prohibited, all issues and questions concerning the construction,
validity, interpretation, and enforceability of these Official Rules, or the
rights and obligations of entrants or winners, Sponsor, and administrator in
connection with this Promotion, shall be governed by, and construed in
accordance with, the laws of the State of Delaware, without giving effect to any
choice of law or conflict of law rules or provisions (whether of the State of
Delaware or any other jurisdiction), which might otherwise cause the application
of the laws of any jurisdiction other than the State of Delaware. Any action
seeking legal or equitable relief arising out of or relating to the Promotion or
these Official Rules shall be brought only in the courts of the State of
Delaware. You hereby irrevocably consent to the personal jurisdiction of said
courts and waive any claim of forum non-convenience or lack of personal
jurisdiction they may have.

The invalidity or unenforceability of any provision of these Official Rules
shall not affect the validity or enforceability of any other provision. In the
event that any provision is determined to be invalid or otherwise unenforceable
or illegal, these Official Rules shall otherwise remain in effect and shall be
construed in accordance with their terms as if the invalid or illegal provision
were not contained herein.




8. NOTICE TO INDIVIDUALS: REMOVAL FROM MAILING LIST:

Any individual (or other duly authorized person) may elect to exclude the name
and address of that individual from all lists used by the Company to mail future
skill contests, giveaways or sweepstakes. To elect to have an individual’s name
excluded from all such lists, submit a removal request in writing to “2nd.MD,
9655 Katy Freeway, Suite 300, Houston, Texas 77024”. This notification system
will be used to prohibit mailing of all skill contests, sweepstakes by the
Company to such individual.




9. PRIVACY POLICY:

We recognize the personal nature of our services and assure you that all your
identifying information will be removed from your responses. We take pride in
our ability to continue to maintain the utmost privacy for our respondents. We
will not share your contact information with third parties without your
