information about yourself upon registration such as your name, company, and,
email address, and in the instance of a purchase, your credit card information.
Upon further visits to HR.com, we may ask you to further complete your profile
with the following information: address, areas and topics of interest, company
name, job title, and your function in the human resources field (ie. HR
professional vs. HR solution provider). By providing any personal information to
this website, you fully understand and unambiguously consent to the collection
and processing of such information in any country.

In some cases, HR.com may also leverage third party tools to collect additional
(publicly available) information for your profile, or to update existing data
and information which you have provided HR.com. The type(s) of data that we
could collect using these tools are only those that HR.com asks for during
website registration. HR.com does not aim to collect additional person
information on users which we do not ask for upfront; upon registration to our
website. 

Some personal information may be collected about you if you choose to
participate in our industry research surveys. In particular, your responses to
survey questions, as well as details about how you connected to this survey
website, including your IP address, and the date and time when you connected may
be collected.

Our Web server collects the IP address, operating system and browser software

 * Your registration information is captured in our database when you become an

 * When members register to participate in our live or archived sponsor
   webcasts, download white papers from the website, or respond to our vendor
   email marketing campaigns, full contact information of the user may be
   provided to the vendor according to any contract agreement with that
   particular vendor/sponsor. Members can opt-out of email campaigns at any time
   through a one-click unsubscribe link in the email or through their Manage
   Subscriptions preferences on their HR.com membership profile. The revenue
   derived from these promotions sponsored by vendors enables us to supply
   leading-edge content, subsidize the production of our Website and support
   research and development efforts.
 * When members participate in our industry research surveys, full contact
   information and survey answers may be provided to the vendor according to any
   contract agreement with that particular vendor/sponsor. All promotions are
   sent out through www.hr.com. Members can opt-out of research survey
   promotions at any time through a one-click unsubscribe link in the email or
   through their Manage Subscriptions preferences on their HR.com membership
   profile.
 * We disclose site use information (i.e., impressions and click-throughs on a
   company's advertisement) to third-party sponsors/advertisers aggregate
   statistics. In addition, we may share aggregate website statistics with the
   media or other third parties. We do not disclose personal information to
   these sponsors/advertisers or other third parties as part of this process,
   only information in an aggregate form.
 * HR.com may place "cookies" in visitor's web browser. The allows HR.com (via
   AdRoll) to display relevant display ads to our potential customers as they
   visit our websites.

5. How to opt-out from your subscriptions and communications

As a part of the HR.com network, you will receive a minimum of 2 pieces of email
a week. This email is our General eBulletin and HR Promotions mailstream which
is a direct advertising mailout from one or more of our valued advertisers or it
may contain news and interviews related to the industry from a vendor.
Registered users of HR.com will also be offered a variety of other email or
mailstreams such as industry-specific eBulletins and HR.com announcements and
surveys. You have the option to remove yourself from these particular mail-outs
whenever you wish. As part of our network, there is a mandatory requirement to
subscribe to 1 HR Promotions mailout per week. Unsubscribing from this HR
Promotions stream will deactivate your profile and cause inaccessibility to the
site.

If you no longer wish to receive specific communications or subscriptions, you
have the following opt-out options:

 1. By unsubscribing through the one-click unsubscribe link or Manage
    Subscriptions link in an email
 2. By logging in to your account at www.hr.com and updating your preferences in
    the Manage Subscriptions tab of your profile
 3. By emailing info@hr.com or calling 1-877-472-6648 or 1-905-727-1340

6. How HR.com protects your personal information

For all our transactions, we employ reasonable and current Internet security
methods and technologies. Where appropriate, we password protect, use SSL
encryption techniques for credit card information and install firewalls. We
strive to protect you. We encourage our participating service providers to adopt
and honor their own consumer privacy policies. For all our efforts to safeguard
your privacy, no system can be guaranteed. We cannot ensure or warrant the
security of any information that you transmit to us, or that we transmit to you,
or guarantee that it will be free from unauthorized access by third parties.
Once we receive your information, we use reasonable efforts to ensure its
security on our systems.

7. Who HR.com shares your information with

In order to provide you with co-branded services, and to improve our features,
we will sometimes share your information with our partners.

We reserve the right to disclose any information if such action is necessary (a)
to conform to the requirements of the law or to comply with legal process or
subpoena served on HR.com, (b) to protect and defend the legal rights or
property of HR.com, the Site, or its users, or (c) in an emergency, to protect
the health and safety of its users or the general public. We further reserve the
right to release any information concerning any user if that user participates
(or is reasonably suspected of participating) in any illegal activity, even
without a subpoena, warrant, or other court order. We cooperate with law

of any such event (to the extent it occurs) will be posted on the HR.com
website, and we will require that the new combined entity follow the practices

8. Access to Your Information /Your Data Subject Rights

At any time, HR.com members may directly access their online profiles and other
personal details to amend, update, add, or delete information themselves by
logging in to their account at www.hr.com and selecting "Update My Profile" or
"Manage Subscriptions" under your profile picture in the upper right hand corner
of the header.

You have the following rights with respect to your personal data, as fully
compliant with the General Data Protection Regulation (GDPR). You can also
request access to information we hold about you, ask us to correct any
information that may be inaccurate and/or ask us to block or delete such
information, and object to the processing of information (within the limits of
applicable law).

To raise inquiries about your information in our possession, please email us at
info@hr.com. We may require you to prove your identity with approved
identification before fulfilling your request. We will respond to your request
within 30 days. Please note that we need to retain certain information for
recordkeeping purposes and/or to complete any transactions that you began prior
to requesting such access, change or deletion.

9. Using HR.com website blogs, message boards, discussion forums, and moderated
chats

These services are available to all members on the website. If you choose to
voluntarily disclose certain information on any such public area of the Site,
this Privacy Policy will not cover such disclosure of information. We urge

HR.COM TERMS AND CONDITIONS OF USE/CONTENT AGREEMENT

Welcome to HR.com. We are fully CASL, CAN-SPAM and GDPR compliant. The following
terms and conditions are important things that you should know before using or
accessing HR.com. Please read them carefully. By accessing or using any part of
HR.com or any of the products or services offered by or through HR.com, you
agree to be bound by the following terms and conditions of use. If you do not
wish to be bound by these terms and conditions, you may not access or use
HR.com. If these conditions change, you will be notified via email.

HR.com and its affiliates and partners respect the privacy of its visitors.
HR.com is a community, resource and social network based site.

Users will be required to enter valid contact data. As a part of the HR.com
network, you will receive a minimum of 2 pieces of email a week. This email is
our General eBulletin and HR Promotions mailstream which is a direct advertising
mailout from one or more of our valued advertisers or it may contain news and
interviews related to the industry from a vendor. Vendors will receive our
monthly vendor newsletter. Registered users of HR.com will also be offered a
variety of other email or mailstreams such as industry-specific eBulletins and
HR.com announcements and surveys. You will have the option to remove yourself
from these particular mailouts whenever you wish. As part of our network, there
is a mandatory requirement to subscribe to 1 HR Promotions mailout per week.
Unsubscribing from this HR Promotions stream will deactivate your profile and
cause inaccessibility to the site.

Cancellation Policy

There are many products and services on HR.com, including vendor offers, that
have fees or charges associated with them. It is assumed that existing HR.com
network users, and individuals new to the site, who buy or pay for these
services are fully aware of what they are buying/purchasing and that they have
read all documentation (product descriptions, advertising, etc.) regarding the
product, service, etcetera, to have made that choice. There are no refunds
whatsoever for our Recertification Program, HR Genius, Professional Education
Courses, HR.com Prime, or HR.com Prime Plus once activity on the site has been
established after the purchase of that program. There are no refunds whatsoever
on aPHR exam vouchers, PHR exam vouchers, or SPHR exam vouchers. Other products
that have been determined to be defective or damaged can be returned to us for a
full refund within a reasonable amount of time deemed by one of our sales
representatives (via email or documented phone call). The cancellation policy of
other products, services, etcetera that appear on HR.com but are offered by
other companies or individuals, are the sole responsibility of those companies
or individuals. HR.com does not assume any liability of any sort resulting in
the purchase of those particular products, services, etcetera and does not
endorse the purchase of the same.

Use of 3rd Party Affiliate Programs

We are a participant in the Amazon Services LLC Associates Program, an affiliate
advertising program designed to provide a means for us to earn fees by linking
to Amazon.com and affiliated sites.

 

Copyright and Permitted Use of HR.com Materials/Content

HR.com is owned and operated by HR.com Limited. Except where otherwise noted,
the content of HR.com's web pages that have been created, provided, written and
published by HR.com staff, including the design, text, graphics and arrangement
thereof, and the software used herein, is the property of and is owned and
controlled by HR.com Limited and is the copyrighted material of HR.com Limited
or its content providers. ALL RIGHTS ARE RESERVED. No materials from HR.com that
have been created, written and published by HR.com staff, may be copied,
duplicated, downloaded, reproduced, sold, resold, shown or played in public,
republished, uploaded, posted, stored, transmitted or distributed, adapted or
changed in any way or otherwise exploited for any commercial purpose that is not
expressly permitted by HR.com, except that you may electronically copy and print

No License

Except as expressly provided, nothing contained in these terms and conditions or
anywhere on HR.com shall be construed as conferring any license under any
intellectual property rights of HR.com Limited or any third party.

Rules at HR.com

To guide you in using HR.com responsibly, HR.com Limited has established the
following rules. If you do not abide by these rules while using HR.com, HR.com
Limited has the right to prohibit you from using HR.com and may terminate any
account (without a refund) that you may have on HR.com. While using HR.com, you
may not:

1. upload, post, email, transmit or otherwise distribute any data, text,
information, messages, software, music, sound, photographs, graphics, video
messages or other material:

 * constituting or encouraging conduct that would intentionally or
   unintentionally violate any applicable local, state, provincial, national or
   international law or give rise to civil liability, or otherwise use HR.com in
   a manner which is contrary to law;
 * that is harmful, threatening, abusive, harassing, tortious, defamatory,

2. upload, post, email, transmit or otherwise distribute any unsolicited or
unauthorized advertising, promotional materials, "junk mail", "spam", "chain
letters", "pyramid schemes", or any other form of solicitation except where
specifically permitted on HR.com;

3. impersonate any person or entity or falsely state or otherwise misrepresent
your affiliation with any person or entity; or

4. collect or store personal data about other users of HR.com.

While using HR.com you will likely access third party websites through search
results displayed on HR.com and links contained on HR.com. Such third-party
websites are not under the control of HR.com Limited and HR.com Limited is not
responsible for the availability of such sites or their contents. Any links
provided on HR.com are provided for your interest or convenience only and do not
represent or imply any endorsement by HR.com Limited of any such linked site.
You acknowledge that the use of such third party websites is governed by the
terms and conditions of use applicable to any such site.

HR.COM LIMITED SHALL NOT BE RESPONSIBLE OR LIABLE, DIRECTLY OR INDIRECTLY, FOR
THE ACCURACY, CONTENT, TIMELINESS, COMPLETENESS, LEGALITY, RELIABILITY, QUALITY,
SUITABILITY OR DECENCY OF ANY INFORMATION, ADVICE, CONTENT, SERVICE, PRODUCT OR
MERCHANDISE CONTAINED IN SITES LISTED IN SEARCH RESULTS ON HR.COM OR OTHERWISE

Third Party Services

You may order services or merchandise through HR.com. All matters concerning the
merchandise and services desired from Seller, including but not limited to
purchase terms, payment terms, warranties, guarantees, maintenance and delivery,
are solely between you and Seller. You will not consider HR.com as a party to
such transactions, whether or not we may have received some form of revenue or
other remuneration in connection with the transaction or be liable for any costs
or damages arising out of, either directly or indirectly, you or any other
person involved or related to the transaction.

User Content/ Content Agreement

HR.com enables its users to post content (ie; articles, reviews, blogs, wikis,
etc.) and comments on content, products and services (herein known as "Your
Content"). Such users are solely responsible for any and all information posted
as well as any consequences that may result from "Your Content". In posting your
material, you are agreeing that you are the sole creator of that content and you

submitting any of Your Content to HR.com Limited, you automatically grant to
HR.com Limited a perpetual, royalty free, irrevocable, non-exclusive right and
license to use, reproduce, modify, adapt, publish, translate, create derivative
works from and distribute and display any of Your Content into any form, medium
or technology now known or hereafter developed. -- This agreement does not in
any way limit the Author(s) ability to use or publish their content elsewhere
and the Author(s) shall retain the copyright.

2. The Author(s) represents and warrants that the Content provided is original
and does not violate or infringe upon any intellectual property rights of any
person or entity, including without limitation, any copyright, trademark,
patent, statutory, common law or the proprietary rights of others, or contain
libelous or obscene material.  Any excerpts from other copyrighted works shall
only be included in the Content with the prior written permission of the
copyright owners.

3. If relevant, the Author(s) will take reasonable care in checking facts and
statements and keep all notes and tape recordings made in the course of
researching and writing the article.  The notes will be made available to HR.com
Limited to defend against any legal action or otherwise, and the Author(s) will
cooperate with HR.com Limited and its attorneys should the need arise.

4. If relevant, the Author(s) agree(s) to keep notes related to the Content for
a period of five (5) years.

5. The Author(s) grant(s) HR.com Limited the right to use the Author's (s')
name(s) and likeness in promoting the Content and HR.com Limited. HR.com Limited
reserves the right to edit all accepted Content to conform to our style
presentation and format, taking care not to change the Author's (s') meaning.

6. The Author(s) indemnifies and agrees to hold HR.com Limited, its parents,
subsidiary and affiliated companies and their successors, officers, directors
and employees harmless from any damage, cost of expense, including reasonable
attorneys fees and costs of settlement, related to any claim, action or
proceeding arising out of or in connection with this Agreement and/or the
Author's representations or warranties hereunder.

By providing Your Content through any publicly accessible areas of HR.com or
submitting any of Your Content to HR.com Limited, you warrant that Your Content
is not subject to any third party copyright or any other proprietary right and
that you have full capacity and authority to make such posting, transmission,
distribution or submission.

General Disclaimer of Representations and Warranties

HR.com Limited is providing HR.com on an "AS IS, AS AVAILABLE" basis to users.
HR.com is a service to users seeking human resources news and information. You
use HR.com at your own risk. Neither HR.com Limited nor any of its officers,

Indemnification and Release

You agree defend, indemnify and hold harmless HR.com Limited and its affiliate
and related companies, officers, directors, shareholders and employees from any
and all claims, liabilities, damages, costs and expenses, including reasonable
legal fees, arising from (a) your use of HR.com or the internet, (b) the
uploading, posting, emailing, reproducing, transmitting or otherwise
distributing of any information, data, text, software, music, sound,
photographs, graphics, video messages or other materials by you or any users of
any account that you may have with HR.com Limited, or (c) the breach of any of
these terms and conditions by you or any users of any account that you may have
with HR.com Limited.

Miscellaneous

These terms and conditions and any and all documents specifically referenced
herein, including our content agreement, constitute the entire agreement between
you and HR.com Limited with respect to the subject matter hereof. No failure on
the part of HR.com Limited to exercise and no delay in exercising any right
under these terms and conditions shall operate as a waiver of such right. If any
provision contained in these terms and conditions is determined by a court of
competent jurisdiction to be illegal, invalid or otherwise unenforceable, that
provision shall be severed from these terms and conditions and the remaining
provisions shall continue in full force and effect.

Privacy Policy

Please also fully read our privacy policy by clicking here or selecting the
"Privacy & Terms" menu located on the www.hr.com website. By selecting "I agree
to HR.com's terms of service and privacy policy", the user hereby indicates that
she/he understands fully all aspects and rules applicable to the user and that
the user will abide by this agreement.

REFUND POLICIES FOR HR.COM PRODUCTS & SERVICES

Certification Live Instructor-Led Courses

Refunds are available prior to one (1) week before the official start date of
the program in which you have registered. No refunds will be processed within
one (1) week of the official start date of the program, or at any time after the
start of the program in which you have registered. Course selection may not be
changed within one (1) week of the start of the program in which you are
registered.

For all cancellations by the registrants prior to one week from the program
start date, refunds will be issued minus a $100 administrative and shipping
expense fee.

Shipping and late registration fees will not be refunded.

Before refund is issued, materials must be returned to HRCP and received by the
HRCP office within 30 days of receipt. Return shipping costs are not included.

Certification Self-paced eLearning Course

Refunds may be available within one (1) week from the initial date of
enrollment. HR.com's reserves the right to review each request for a refund, on
a case-by-case basis, for validity.

Before refund is issued, materials must be returned to HRCP and received by the
HRCP office within 30 days of receipt. Return shipping costs are not included.

Certification Materials Only Purchase
Refunds may be available within 30 days from the initial date of purchase.
Materials must be returned to HRCP and received by the HRCP office within 30
days for a full refund. Return shipping costs are not included.
 

Certification Exam Vouchers

No refunds are available on the purchase of aPHR, PHR, or SPHR exam vouchers.

Recertification Program

No refunds are available on the purchase of HR.com's Recertification Program.

Professional Education Courses

No refunds are available on the purchase of Professional Education Courses

HR.com Prime and/or Prime Plus Membership

No refunds are available on the purchase of HR.com's Prime and/or Prime Plus
Membership.

HR Genius Monthly and Annual Programs

No refunds are available on the purchase of HR.com's HR Genius Monthly and
Annual Programs.

Certification Program Deferrals (instructor-led programs only)

Registrants who have enrolled and paid for their participation in an HR.com
Professional Certification Preparation Course may be able to defer their studies
to the next immediate semester of study. Individuals deferring their studies
will be subject to a movement fee (prices vary on course; contact HR.com for
details). Course registrants can defer their studies only once following their
initial enrollment into an HR.com Professional Certification Preparation Course.
The cost of deferral is exempt from any possible tuition reimbursement under the
Money Back Guarantee policy.

Certification Program Access and Resources

Registrants of HR.com's Live Instructor-Led Online Course and Self-paced
eLearning Course will have continued access to resources, including affiliated
practice exams, for one (1) year from the time of enrollment, at minimum.

Failure to adhere to HR.com terms and conditions of use as per this doctrine may
terminate access to HR.com and partnership resources and properties.

HR.com's partnership with Human Resource Certification Program (HRCP) permits
access and use of course content for approved registrants only for the purposes
of preparing for a professional certification exam; for individual use.
Violation of intellectual property laws and policies is prohibited and can
result in the termination of the program and/or legal repercussions.

Course participant must:

 * Register for HR.com's Preparatory Certification Course (instructor-led course
   and HRCP Program).
 * Read and study the comprehensive HRCP learning system.
 * Agree to comply with the Guide for Successful Exam Preparations (learning
   contract) online.
 * Complete all included practice exams at HRCP.com with a score of 80% or
   higher on each exam prior to your HR certification exam date. (You can retake
   the practice tests an unlimited number of times). 
 * Be in live, realtime attendance for a minimum of 80% of the total hours in
   session. (ex: If the course runs for 30 sessions, you must be in attendance

Terms and Conditions for aPHR, PHR, and SPHR Exam Vouchers

 * HR.com sells vouchers for the aPHR exam, PHR exam, and SPHR exam which
   provide a unique code to be used in exchange for exam products. Vouchers do
   not have a monetary value and must be used for the purpose or program issued.
 * When an exam voucher is purchased through HR.com as an add-on to a
   certification prep course, HR.com will distribute the voucher code to the
   customer one month after the start of the prep course. If the customer would
   like the voucher code to be distributed sooner or later than one month after
   the start of the course, the customer must notify HR.com by emailing
   certification@hr.com within one week of purchase. A voucher is valid for 365
   calendar days from the date of distribution. During the 365 days, vouchers
   are non-refundable in whole or in part and must be redeemed in a single
   transaction (no remaining credit if not used in whole).
 * Vouchers cover the cost of the exam application fee and exam fee, and cannot
   be combined with any other discount offer or promotions on HRCI.org.
 * Exam candidates who redeem vouchers for payment on HRCI.org must follow all
   applicable eligibility and exam rules. If a candidate does not take the exam
   within the application eligibility period (normally 120 days, but extended to
   180 days for customers purchasing the voucher through HR.com), the candidate
   must reapply to take an exam and pay all applicable fees using a new voucher
   or another payment method.
 * Once candidates schedule an exam, they may reschedule their exam date to
   another date within their original 180-day eligibility timeframe by
   contacting the test center and paying a fee.
 * The exam eligibility is valid for 180 calendar days from the application
   approval date. This means that the exam must be scheduled and taken within
   those 180 calendar days.
 * No refunds are issued to candidates who let the 180-day original eligibility
   period expire without taking an exam.
 * Candidates may extend their 180-day eligibility period by paying a $150
   extension fee. This provides a 60-day extension to the current eligibility
   period that you were provided when you signed up. Limited to one extension
   per exam. Any exam appointment must be canceled prior requesting an extension
   and must be completed at least 10 days prior the end of the original
   eligibility period.
 * No refunds are issued to candidates who are a “no show” for an exam scheduled
   at an exam testing center.
 * Once an exam application is approved, neither exam-type changes or refunds
   will be made if a candidate no longer wishes to take the exam.
 * Candidates may request a voucher code exam type change as long as an
   application has not been approved and an exam appointment has not been
   scheduled.

Terms and Conditions for HR Genius Trials

Signing up for an HR Genius Free Trial: To subscribe to our HR Genius Free Trial
offers, you must provide HR.com with your name, e-mail address and credit card
information. There are two types of trials available; HR Genius Monthly and HR
Genius Annual. By taking the trial, you will NOT be charged during your trial
period, and your credit card is kept on file for further upgrades (if applicable
- for those who do not opt out of our free trials).

Cancellations for trials must take place before the trial expires, by, the
latest, two business days prior to expiration. If no opt out action is taken, it
will be assumed that you agree to continue on with the regular HR Genius
membership package you chose for your trial. Once your trial expires, without
any action taken for opting out, only then will there be a charge on your credit
card. By not opting out, you authorize HR.com or its agent to charge your
Payment Method for the amount of the chosen HR Genius membership package.

You will not be provided with copies of charge slips evidencing any recurring
charges for our HR Genius Monthly Membership package. You agree to pay the
applicable monthly amount in accordance with your Payment Method issuer
agreement, if applicable.
