Selected Plan Domain & Hosting Policy Effective Date: 2021-12-01 1. ELIGIBILITY The Netfy string is a “.Brand SLD” as registered under the ICANN Registry & Mavic Cloud is a brand name of Mavic Platforms. Therefore, only the Mavic One users are eligible to register Domain Names under the Netfy SLDs and host websites under Mavic Cloud, and control the DNS records associated with domain names at any level in the SLD. If the Registrant ceases to be eligible at any time in the future, the Mavicsoft may cancel or suspend the license to use the Domain Name & cloud space immediately, without notice. The registration of Domain Names must be approved by Mavicsoft, in addition to meeting all requirements under the Registry Rules. Registrant eligibility is granted at Netfy's sole discretion. The registration of Domain Names will be centralized and managed only through the Mavicsoft. 2. REVOCATION OF DOMAIN NAMES OR CLOUD SPACE The Registrant acknowledges that the Netfy SLDs Registry may revoke a Domain Name or cloud space immediately at its sole discretion under the following circumstances: 2.1 in the event the Registrant breaches any Registry Rules; 2.2 to comply with applicable law, court order, government rule, ICANN obligations, or under any dispute resolution processes. 2.3 where such Domain Name is used for any of the following prohibited activities (“Prohibited Activities”): 2.3.1 spamming 2.3.2 pornography 2.3.3 illegal drug 2.3.4 registrant is a minor without parental guidance or use the app for inappropriate works 2.3.5 false news publications 2.3.6 hate speech or religion, race targeted materials 2.3.7 obscene speech or materials 2.3.8 defamatory or abusive language 2.3.9 forging headers, return addresses and internet protocol addresses 2.3.10 Cloud resources violation and excessive usage of abuse activities. 2.3.10.1 Its prohibited to use Mavic Cloud resources as File Storage or Backup. 2.3.10.2 any other illegal or prohibited activities as determined by the Registry at it sole discretion 2.3.11 intellectual property and privacy violations 2.3.12 trademark violations 2.3.13 copyright violations 2.3.14 illegal or unauthorized access to other computers or networks using Mavic One resources 2.3.15 distribution of internet Viruses, Worms, Trojan horses, Phishing, Illegal Bots or other destructive activities 2.4 in order to protect the integrity and stability of the domain name system and theRegistry. 2.5 to avoid any liability, civil or criminal, on the Registry's part as well as its affiliates, subsidiaries, officers, directors, employees, and subcontractors. 2.6 to correct mistakes made by the Registry or any Registrar or any of its service providers in connection with an application for a domain name. 2.7 where such Domain Name is placed under the ICANN Reserved Names list as defined in the Registry 2.8 if at any time the Registry deems, at its sole discretion, that the Registrant no longer meets 2.9 where Registrant fails to make any required payment to the Registrar for registration, renewal or any other relevant services 2.10 It's not prohibited to use Mavic Cloud resources for File Sharing, Including Images & Video or any type of files, Streaming Services, Hosted Online Gaming or Heavy Scripting but limited not to abuse the cloud resources and, In any such violation or detection of abuse Mavic Cloud has sole discretion to suspend the cloud space or domains or both. 3. REQUIRED CRITERIA FOR DOMAIN NAME & CLOUD SPACE REGISTRATION An application for Domain Name registration must meet all the following criteria: 3.1 If the applicant is a minor, the applicant should have a consent from the guardian 3.2 purpose should be legal and comply with section 2.3 criteria. 3.3 the Domain Name is not already registered. 3.4 the Domain Name is not reserved or blocked by the Registry; 3.5 the Domain Name consists of a minimum of 4 and a maximum of 63 characters (after its conversion into ASCII for IDNs); 3.6 any additional technical requirements as required by the Registry from time to time; and 3.7 compliance with all requirements under the Registry Rules. 4. ALLOCATION OF DOMAIN NAMES The Registry will register Domain Names on a first-come, first-served basis in accordance with the Registry Rules. The Registry does not provide pre-registration or reservation of Domain Names. 5. FREE STUDENT DOMAIN REGISTRATION GUIDELINES 5.1. Introduction As part of our commitment to providing free domain name registration, we offer individuals the opportunity to register a free student domain name. This service is open to everyone, and the term "student domain" is used solely as a name and does not imply any restrictions based on student status or commercial use. To maintain a safe and responsible environment, we have established the following guidelines that must be adhered to when registering a free student domain name. 5.2. Eligibility The registration of free student domains is open to everyone and is not limited to students or non-commercial use. It is available for both non-commercial and commercial purposes. 5.3. WhatsApp Three Factor Authentication (3FA) To authenticate and complete the registration process for a free student domain name, users are required to submit WhatsApp Three Factor Authentication (3FA). This additional security measure is exclusive to free student domains and helps ensure the legitimacy of registrations. Users do not need to provide WhatsApp 3FA for paid domains. 5.4. Generic names such as "download," "about," or "contact" that do not reflect the registrant's identity or purpose are discouraged. 5.5. Prohibited Activities While registering a free student domain name, users are expected to adhere to the following guidelines: 5.5.1. Trademark Compliance: Registrants must not register domain names that infringe upon or imitate trademarks or intellectual property owned by third parties, including existing businesses or brands. 5.5.2. Phishing: The registration of domain names for the purpose of engaging in phishing or fraudulent activities is strictly forbidden. 5.5.3. Responsible Use: While commercial use is permitted, registrants must engage in responsible and legal activities with their free student domains. 5.6. Enforcement We reserve the right to monitor domain registrations and take appropriate action in cases of policy violations. This may include domain suspension or termination of the free student domain registration service for individuals found in breach of these guidelines. 5.7. Reporting Violations If you suspect that a registered domain name violates these guidelines or if you believe that your intellectual property rights have been infringed upon, please contact our abuse report center here immediately for further investigation. 5.8. Conclusion By registering a free student domain name with us, you acknowledge and agree to abide by these Free Student Domain Registration Guidelines. Failure to comply with these guidelines may result in the suspension or termination of your free student domain registration. TERM OF REGISTRATION / RENEWAL Initial term of registration: A Netfy SLD Domain Name can be registered for a maximum 1 year period and a general TLD domain name can be registered for a period between one (1) to ten (10) years. Upon registration of a Domain Name, the Registrant holds a license to use the Domain Name for the registration period. Renewal of registration: The Netfy SLD domain name term may be extended at any time when the user renews for any Mavic Cloud hosting plan and TLD domain names term may be extended at any time for a period between one (1) to ten (10) years, provided that the total aggregate term of the Domain Name does not exceed ten (10) years at any time. Cancellation of registration: The Registrant may cancel a Domain Name registration at any time by submitting its request in writing to the Registrar. 7. TRANSFER OF DOMAIN NAMES BETWEEN REGISTRANTS Any transfer of a Netfy SLD domain name is prohibited and Netfy SLD domains must only be registered via netfy domain registration platform and any transfer of a TLD Domain Name between Registrants must be approved in writing by the Registry through the Registrar and meet all requirements within the Registry Rules. 8. DOMAIN INTEGRATIONS POLICY Introduction At Mavic Platforms, we provide users with the opportunity to connect their free domains to various popular websites. We call this feature "Domain Integrations." This policy outlines the guidelines and expectations for using this service responsibly and effectively. 8.1. Timely Setup Upon requesting domain integration, users are expected to complete the setup on the third-party website within 48 hours of the request. Failure to do so may result in the cancellation of the domain integration connection. 8.2. Prevention of Domain Abuse 8.2.1 Prohibited Content Users are strictly prohibited from integrating our free domains with websites that contain spam, scam, or malicious content. Such content includes, but is not limited to: - Phishing websites - Malware distribution - Fraudulent schemes - Deceptive content 8.2.2 Detection and Suspension We actively monitor the content associated with our free domains. If we detect any violation of our content policies, we reserve the right to suspend the domain immediately. Users will be notified of the suspension and may appeal the decision. 8.3. Reporting Abuse If you come across any domain integrated with our service that you believe violates our policies, please report it to [support center abuse url]. We appreciate your assistance in maintaining a safe online environment. 8.4. User Responsibility Users are responsible for ensuring that the content of their integrated domains complies with all applicable laws and regulations. Mavic Platforms will not be held liable for any legal consequences resulting from the use of our free domains. 8.5. Policy Updates This Domain Integrations Policy may be updated periodically to reflect changes in our services or regulations. Users will be notified of any significant policy changes. By requesting domain integration, users agree to abide by the terms outlined in this policy. Failure to comply with these guidelines may result in the suspension of domain integration privileges. 9. FREE STUDENT HOSTING ACCOUNT INACTIVITY POLICY Our 'Free Student Hosting Account Inactivity Policy' is designed to ensure efficient resource management and security for our student users. If you're on our free student hosting plan and don't log in within 30 days, your account will go offline temporarily. After 45 days of inactivity, the account will be permanently deleted. Simply log in within the specified timeframes to maintain access and safeguard your data. This policy helps optimize service quality and protect your student account. Thank you for your attention to this policy. 10. PRIVACY AND DATA PROTECTION By registering a Domain Name, the Registrant consents to, and authorizes the Registry to process personal information and other data required for the operation of the Netfy SLD orany other TLD. The Registry will only use the data for the operation of the Registry,including, but not limited to, its internal use, communication with the Registrant or the Registrar, and provision of a WHOIS look-up facility. 11. PRICING / PAYMENT The all Netfy SLD domains are free to use and all other TLD domains Registry does not currently charge a separate fee for the Registrar to register Domain Names. In the event fees are charged, the Registry will provide Registrars with 30 days' notice of any price change for new registrations and 180 days-notice of any price change for renewals in accordance with the Registry Agreement. 12. DISPUTE RESOLUTION The Registrant agrees to be bound by ICANN's Dispute Resolution Policies in respect of all disputes in connection with the Domain Name. 14. COMPLIANCE WITH CONSENSUS AND TEMPORARY POLICIES The Registrant agrees to be bound by all applicable consensus and temporary policies as required and mandated by ICANN, from time to time. 15. AMENDMENTS TO THE POLICY The Registry may modify this Policy from time to time at its sole discretion. Any modifications or amendments to this Policy shall be effective upon posting on the Netfy Registry website under legal links and giving thirty (30) days prior written notice to all accredited Registrars. PURPOSE 1.1 Subject to the terms and conditions of this Agreement, Mavicsoft hereby grants to netfy domain owners, free hosting content creators, Partners, advertisers worldwide right and license to use the Mavicsoft Drifting Ads Service on all free netfy and all free hosting websites without prior inform to the content creator of the relevant hosted website or netfy domain. All ads published on these free domain, free hosting websites are strictly monitored by the Mavicsoft and according to the Mavicsoft domain policy (https://support.mavicsoft.com/domain-hosting-policy.php) all the ads are complied with this domain policy and hence no restricted materials or ads will be distributed via Mavicsoft Drifting Ad Service. And this is an unified ad sharing program through netfy and other free resources. 2.GRANT OF LICENSE. 2.1 Subject to the terms and conditions of the Agreement, Mavicsoft hereby grants to Partner, worldwide, non-sublicensable, non-transferable right and license to (i) use the Mavicsoft Ads Drifting Solution for the provision of the Services via the Partner Approved Marketing Channel, ads publish on any FREE hosted website on Mavic Cloud and (ii) use the Documentation internally for the sole purpose of providing the Services and the Mavicsoft Ads Drifting Solution to End Users, as permitted and applicable under the Agreement. 2.2 All rights which are not expressly granted herein are reserved by Mavicsoft. Partner may not make any use of the Mavicsoft Ads Drifting Solution in whole or in part in any manner not expressly permitted by the Agreement. 2.3 Subject to the terms and conditions of the Agreement, Partner hereby grants to Mavicsoft a royalty-free, non-assignable, non-transferable, non-sublicensable license during the Term to: use display and access the Partner Materials through or in connection with the Mavicsoft Solution. 3.MAVICSOFT’S RIGHTS AND OBLIGATIONS. 3.1 Mavicsoft retains the exclusive right to determine and set, from time to time, the advertisers and/or Monetization Source, or any functionality or features available in or presented through or in connection with the Services and the Mavicsoft Solution, including, without limitation, any advertisements, search results, sponsored results or the use of the Partner Materials and the Approved Marketing Materials in connection with the Mavicsoft Solution. 3.2 During the Term, Mavicsoft may, in its sole discretion, update and/or upgrade the Mavicsoft Ads Drifting Solution or discontinue any part thereof. 3.3 Partner agrees that Mavicsoft may (a) feature the Partner name and Partner Materials in different marketing outlets and/or collateral, including, without limitation, newsletters, case studies, web pages and email or ad campaigns; (b) identify Partner as a user of the Mavicsoft Ads Drifting Solution on Mavicsoft websites, Mavic Cloud, Netfy domain users, client lists and in other marketing materials and channels as well as, when required, to any and all providers of advertising; and/or (c) use the Partner Materials or the Approved Marketing Materials to create an online demonstration version of the Partner Approved Marketing Channel hosted by Mavicsoft for display and presentation purposes only to potential Partners, including, without limitation, the Monetization Source. 3.4 Subject to the availability of data from third party providers, Mavicsoft shall provide Partner with access to an online portal where Partner can view reports and analysis regarding the performance of the drifting ads in a form determined from time to time by Mavicsoft (the “Reports” via mPanel, if only user subscribed for the detail report plans). Notwithstanding the foregoing, Mavicsoft will not be liable for any unavailability or inaccuracy, temporary or otherwise, of any data or information provided within the Reports. 3.5 At any given time, by any electronic media, Mavicsoft or the Monetization Source at Mavicsoft’s expense, will be entitled to examine those records of Partner and the Partner’s use of the Mavicsoft ads Solution that are reasonably necessary to determine Partner’s compliance with its obligations under the Agreement. Partner undertakes to cooperate with Mavicsoft to the reasonable extent required by Mavicsoft in order to perform the compliance examination set forth in this section and shall immediately correct any noncompliance or follow any instructions provided by Mavicsoft following said examination. In case of a material noncompliance, Mavicsoft shall be entitled to immediately terminate Partner’s right to use the ad solution in accordance with this Agreement. 3.6 Upon any material change to the Standard Terms (excluding changes made to comply with legal requirements), Partner will be entitled to immediately terminate the Agreement without any right for compensation. All other changes to the Standard Terms and any amendments made to comply with legal requirements will become effective immediately upon their posting on the applicable web page. Mavicsoft will also update the “Last updated” on the applicable web page upon any such change. 4.PARTNER’S RIGHTS AND OBLIGATIONS. 4.1 Partner may seek to use the Mavicsoft Ads Drifting Solution through or in connection with one or more of the Partner Approved Marketing Channel formly all free netfy domain names, as detailed in the applicable IO, in accordance with the terms of the Agreement, and subject to such Partner Approved Marketing Channel’s full compliance with the terms and conditions of the Agreement. Each such Partner Approved Marketing Channel will be subject to Mavicsoft’s prior approval. Partner further undertakes to obtain Mavicsoft`s prior approval before any material change is made to the design, architecture or functionality of the Partner Approved Marketing Channel version that was approved by Mavicsoft. Breach of this Section 4.1 shall entitle Mavicsoft to any recourse out lined in this Agreement. 4.2 Under no circumstances may the Partner offer, promote or provide access to any part of the Mavicsoft ads Solution, either directly or indirectly, on websites, applications or online services or through the use of any advertisement, content, or other materials that (i) contain any Prohibited Activity or Fraudulent Activity, or (ii) are directed to children under 13. Partner further undertakes that it shall not, nor shall it allow any other person or entity to engage in any Prohibited Activity or Fraudulent Activity or use the Mavicsoft Ads Drifting Solution and any of its related features in connection with or in any manner that constitutes Prohibited Activity or Fraudulent Activity. 4.3 Partner acknowledges that Mavicsoft shall have the right to disapprove previously approved Partner Approved Marketing Channel in the event that any of those are determined by Mavicsoft, to contain Fraudulent and/or Prohibited Activity. Upon receipt of notice of Mavicsoft’s rejection of a new or previously approved Partner Approved Marketing Channel, Partner shall immediately cease using the Mavicsoft Ads Drifting Solution with any or all of them referenced in the notice. In such case, Mavicsoft may terminate the Agreement with immediate effect upon providing notice to Partner and Mavicsoft shall not have any liability to Partner whatsoever. 4.4 Partner will not, and shall ensure that no other person or entity will, or attempt to, interfere with or disrupt the Mavicsoft Ads Drifting Solution or attempt to gain access to any systems or networks that connect thereto (except as required to access and use the Mavicsoft Ads Drifting Solution for Partner’s own use as permitted herein). Furthermore, Partner will not, and will ensure that no other party or entity will: (a) use, copy, create derivative works of or modify the Mavicsoft Ads Drifting Solution or any part thereof; (b) transfer, sublicense, lease, lend, rent or otherwise distribute the Mavicsoft Ads Drifting Solution to any other person or entity; or (c) use the Mavicsoft Ads Drifting Solution in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with the Agreement or with any applicable law. Partner agrees not to disassemble, decompile, attempt to derive the source code of, or otherwise reverse engineer the Solution or any part thereof, in whole or in part, or permit or authorize any other person or entity to do so. 4.5 Partner will not modify, remove or interfere with any part of the Mavicsoft Solution, including, without limitation, the advertisements or any element or functionality provided by the Monetization Source(s). Without derogating from the foregoing, Partner agrees to display the Mavicsoft Solution, and all elements, features and functionalities thereof in the format received from Mavicsoft, and Partner may not change the design, format, order or content of the Mavicsoft Ads Drifting Solution or any part thereof, without limitation, any Mavicsoft or third party advertisements, content or code, nor alter, modify or otherwise interfere with the operation of any hyperlinks contained therein. 4.6 Without derogating from Mavicsoft’s right of termination under the Agreement, Partner acknowledges and agrees that at any time during the Term, if Mavicsoft believes, in its sole judgment, that a Prohibited Activity or Fraudulent Activity is taking place or Partner is otherwise in breach of the Agreement, Mavicsoft shall have the right (without notice to Partner) to (i) remove and take any measures needed to prevent or correct the (a) Prohibited Activity or Fraudulent Activity from being used in connection with the Mavicsoft Solution, or (b) use of the Mavicsoft Ads Drifting Solution in breach of the Agreement; and/or (ii) suspend or cease to provide the Partner with any of the Mavicsoft Solution. 4.7 In the event that Prohibited Activity or Fraudulent Activity pertaining to the Mavicsoft Ads Drifting Solution or any other activity that could constitute a breach of the Agreement is detected by Partner or comes to the Partner’s attention, Partner shall immediately remove such activity and report to Mavicsoft its actions. 4.8 Partner will not use the Mavicsoft Solution, the Partner Approved Marketing Channel, Marketing Materials or any related application, extension, feature or material to offer, display, distribute, transmit, route, provide connections to or store any content or any other material that infringes or promotes the violation of the Intellectual Property Rights, privacy or other rights of any person or entity. 4.9 Partner must comply with the Documentation, Mavicsoft Guidelines Any deviation from the Documentation Mavicsoft’s Guidelines or instructions must be approved in advance in writing by Mavicsoft. Partner acknowledges and agrees that Mavicsoft has the right to take any measures needed to prevent or correct any integration which does not comply with the Documentation or Mavicsoft’s Guidelines. 4.10 Partner shall prominently display and comply with any privacy policy on the Partner Approved Marketing Channel website including all applicable privacy laws, rules and regulations and includes a full, accurate, and clear disclosure and further Partner shall ensure that it as well as its and any third party properties through which Partner serves the Partner Services hereunder, shall include the required disclosure regarding the collection of information and use of tracking technologies in order to serve advertisements, including any use of behavioral targeting and advertisement and the purposes of behavioral targeting. In addition, Partner shall ensure that it deploys appropriate notices and functionality on the Partner Approved Marketing Channel to obtain prior informed consent from users of the Partner Approved Marketing Channel to the collection of personal information by Partner and Mavicsoft hereunder, and where required by applicable local law placing and reading of third-party cookies and similar third party technologies. Without derogating from the foregoing, the privacy policy of the Partner Approved Marketing Channel shall at all times comply with Mavicsoft’s privacy policy located at https://support.mavicsoft.com/privacy.php 4.11 Partner will not, directly or indirectly, disclose any data collected in connection with the “service” to any third party or use such data for the benefit of any other party, including using such data for research and development, modeling, or providing services to any other party. Partner further agrees not to use any such data, directly or indirectly, for (i) device or cross-device identification, (ii) targeting, including retargeting segmenting, creating or supplementing user profiles or inventory profiles, creating, supplementing or amending interest categories, or syndication or other distribution to third parties, or (iii) sequencing. Partner will not, directly or indirectly, reverse engineer any such data that is masked, hashed, aggregated, or otherwise protected, including, without limitation, ad tags or scripts. Notwithstanding for foregoing, any data related to the use of the Partner Approved Marketing Chanel (excluding use of the Mavicsoft Solution) shall be solely owned by Partner and Partner shall be entitled to use such data as it deems fit.
