Navigating the 9/11 Victim Compensation Fund can be frustrating, complicated and
time-consuming. At Hansen & Rosasco, LLP, it is our goal to take this burden off
you and get you the maximum payout you deserve while allowing you to concentrate
on your health. 

STEP 1

Client calls our office to discuss eligibility for VCF and WTC Health Program.
Client retains Hansen & Rosasco, if eligible.

STEP 2

Hansen & Rosasco registers claim with VCF and begins review of preliminary
documents provided by client.

STEP 3

Hansen & Rosasco begins work to establish “presence” in the NYC Exposure Zone,
including contacting “presence” witnesses. Hansen & Rosasco obtains sworn
witness affidavits and written Victim Presence Statement affidavit.

STEP 4

Hansen & Rosasco helps file a completed claim with WTC Health Program, a step
before the VCF claim can be filed.

STEP 5

Hansen & Rosasco investigates if 9/11 condition disables client from work and
past earning history for potential “loss of earnings award.”

STEP 6

Hansen & Rosasco submits fully completed claim to VCF for review. Usually takes
12-18 months for VCF to review and make award.

STEP 7

VCF makes award determination. Hansen & Rosasco reviews for accuracy and
discusses with client. Client advised if award is correct and, if not, if appeal
should be pursued.

STEP 8

Hansen & Rosasco receives client’s award from VCF into our attorney escrow
account and award is distributed to client after deduction of 10%  government
capped attorney fee. Case is closed for time being, assuming 9/11 condition
remains stable.

You may have 9/11 Victim Compensation Fund (VCF) eligibility if you were present
in the “9/11 Crash Site Area” between September 11th, 2001 and May 30th, 2002.
All 9/11 victims – including first responders and locals in the Lower Manhattan
area – who were exposed to toxins on the day of, and nine months following the

Yes. The 9/11 Victim Compensation Fund calls “pain and suffering” damages
“non-economic loss.” Pain and suffering damages describe the physical pain,
emotional distress, and the loss of enjoyment of life’s activities that a victim
endures as a result of the 9/11-covered physical injuries or illnesses.
Importantly, the 9/11 Victim Compensation Fund does not make an award for
non-physical injuries such as PTSD, but the WTC Health Program does provide
lifetime coverage for counselling for PTSD and other mental health

The 9/11 Victim Compensation Fund has very strict deadlines for filing 9/11
compensation claims. Missing your deadline has a direct impact on your chances
of receiving victim compensation payouts. The registration deadline for the VCF
application is two years from the date that either: (i) the World Trade Center
Health Program (WTCHP) “certified” a cancer or other condition, or (ii) the date
that a state worker’s compensation board or a government employer (such as the
FDNY, NYPD, or NYCERS) found a condition as 9/11-related for purposes of
awarding a disability pension. For deceased/wrongful death claims, the deadline
is July 29, 2021 for the families/estate of anyone who passed before July 29,
2019 or two years from the date of death for families/estate of anyone who
