ANNOUNCEMENTS 2.1 Our primary method of communication is email. All requests, confirmations, changes or cancellations must be communicated to the ‘info@pulakayak.com’ email address to be considered; exceptions are indicated in 3.2. Communications made outside of this channel may not be considered and may affect your eligibility in other parts of these Terms and Conditions. 2.2 Any bookings and alterations to bookings made over the phone or via VOIP technology must be followed up with a response email on behalf of the client. CORRECTIONS 3.1 The customer is obliged to be conscious about his transaction account and all the corrections that are performed. We are allowed to make correction to all mistakes or errors regarding collection of payments, issuance of invoices, calculation of commissions and discounts, and other transactions, including refunds and chargebacks. 3.2 The customer is obliged to announce immediately to us if he knows about mistakes or errors that have been made. Depending on what applies, both parties are responsible for correcting the balance of the transaction account in accordance with the correction that has been made. 4. CHANGES IN THE GENERAL TERMS & CONDITIONS 4.1 We periodically reviews its agreement to the client and may make updates or changes to reflect operating requirements and the responsibilities of us and the client. In the event of changes to the General Terms and Conditions we will notify the client and make available the updated Terms and Conditions. The client must agree to the new terms and conditions before entering into new agreements with us. 4.2 We reserves the right to make changes to the Terms and Conditions without notice. 5. Limitations and Restrictions 5.1 All clients participating in snorkeling must affirm they have previous swimming experience. Clients without swimming or snorkeling experience are not advised to participate in snorkeling tours with us. 6. PAYMENTS 6.1 We offers multiple payment methods, including cash and bank transfers. 7. CANCELLATIONS & SERVICE CHANGES 7.1 Cancellations or changes to service must be communicated as indicated in Section 2. 7.2 We reserves the right to cancel or alter tours and tour content based on availability, demand, weather or logistical concerns, or due to safety considerations. This may occur with little to no notice to the client, however we will endeavor to communicate any changes to scheduled activities at the earliest possible time. It is our the goal to find the best solution for any changes or cancellations in activities and may offer alternative dates or activities. We will also work with the client on a case-by-case basis for all adjustments and cancellations with the client’s interest and safety in mind. 7.3 The client reserves the right to cancel a tour at any time. Tours canceled on the behalf of the client are subject to a cancellation fee based on the type of tour booked and a set notice period: Kayak Tours – Individuals (1 or 2 participants) • Payment is due in full upon booking. • Up to 48 hours prior to the tour departure time, 90% will be refunded. • Within 48 hours of the tour departure time, no refund is available. Kayak Tours – Group Bookings (3 participants or more) • Payment is due in full upon booking. • 8 days or more prior to the tour departure, 90% will be refunded. • 3 days – 7 days prior to the tour departure, 75% will be refunded. • Within 48 hours of the tour departure time, no refund is available. 8. RESPONSIBILITY 8.1 We takes your safety seriously and follows the Standards and Procedures of the „Safety of navigation on the sea and inland waters“. 8.2 We strongly recommends that all clients purchase their own travel insurance to cover unforeseen circumstances arising from vacation activities. 8.3 Subject to our Booking Conditions we are not responsible for any injuries or losses sustained whilst clients are on tours booked with us, whether conducted by us or a third party. 8.4 The client assumes responsibility for their own property and actions while on tour. 8.5 The invalidity of individual clauses of this agreement does not affect the validity of the document as a whole. 9. CONFINDENTIALITY 9.1 We may collect personal information about clients to further the service provided. This may include names, email addresses or other identifying information. At no time does we collect credit card information and requires that all payments be made via bank transfer or in cash. 9.2 We may use your email to periodically send newsletters or other information. We are allowed to make correction to all mistakes or errors regarding collection of payments, issuance of invoices, calculation of commissions and discounts, and other transactions, including refunds and chargebacks. 3.2 The customer is obliged to announce immediately to us if he knows about mistakes or errors that have been made. Depending on what applies, both parties are responsible for correcting the balance of the transaction account in accordance with the correction that has been made. 4. CHANGES IN THE GENERAL TERMS & CONDITIONS 4.1 We periodically reviews its agreement to the client and may make updates or changes to reflect operating requirements and the responsibilities of us and the client. In the event of changes to the General Terms and Conditions we will notify the client and make available the updated Terms and Conditions. The client must agree to the new terms and conditions before entering into new agreements with us. 4.2 We reserves the right to make changes to the Terms and Conditions without notice. 5. Limitations and Restrictions 5.1 All clients participating in snorkeling must affirm they have previous swimming experience. Clients without swimming or snorkeling experience are not advised to participate in snorkeling tours with us. 6. PAYMENTS 6.1 We offers multiple payment methods, including cash and bank transfers. 7. CANCELLATIONS & SERVICE CHANGES 7.1 Cancellations or changes to service must be communicated as indicated in Section 2. 7.2 We reserves the right to cancel or alter tours and tour content based on availability, demand, weather or logistical concerns, or due to safety considerations. This may occur with little to no notice to the client, however we will endeavor to communicate any changes to scheduled activities at the earliest possible time. It is our the goal to find the best solution for any changes or cancellations in activities and may offer alternative dates or activities. We will also work with the client on a case-by-case basis for all adjustments and cancellations with the client’s interest and safety in mind. 7.3 The client reserves the right to cancel a tour at any time. Tours canceled on the behalf of the client are subject to a cancellation fee based on the type of tour booked and a set notice period: Kayak Tours – Individuals (1 or 2 participants) • Payment is due in full upon booking. • Up to 48 hours prior to the tour departure time, 90% will be refunded. • Within 48 hours of the tour departure time, no refund is available. Kayak Tours – Group Bookings (3 participants or more) • Payment is due in full upon booking. • 8 days or more prior to the tour departure, 90% will be refunded. • 3 days – 7 days prior to the tour departure, 75% will be refunded. • Within 48 hours of the tour departure time, no refund is available. 8. RESPONSIBILITY 8.1 We takes your safety seriously and follows the Standards and Procedures of the „Safety of navigation on the sea and inland waters“. 8.2 We strongly recommends that all clients purchase their own travel insurance to cover unforeseen circumstances arising from vacation activities. 8.3 Subject to our Booking Conditions we are not responsible for any injuries or losses sustained whilst clients are on tours booked with us, whether conducted by us or a third party. 8.4 The client assumes responsibility for their own property and actions while on tour. 8.5 The invalidity of individual clauses of this agreement does not affect the validity of the document as a whole. 9. CONFINDENTIALITY 9.1 We may collect personal information about clients to further the service provided. This may include names, email addresses or other identifying information. At no time does we collect credit card information and requires that all payments be made via bank transfer or in cash. 9.2 We may use your email to periodically send newsletters or other information. This may be ceased at any time by replying to the email and requesting that such communications be stopped. 10. DISPUTES & VENUE 10.1 In case of a dispute between us and the client, or those that consider themselves a party to this agreement, and the dispute arises because of these general terms and conditions, disagreement, breaches of the general terms and conditions or the agreement based on them, the venue for such disputes is in the District Court of Pula. 10.2 Croatian laws apply to the relationship between the client and us. With regards to foreign business of the customer that we are handling, the laws of the relevant country apply, unless specifically otherwise agreed upon. 11. CUSTOMER DECLARATION 11.1 By agreeing to this application and these general terms and conditions, the client confirms that he has studied the general terms and conditions for partnership with us in detail and accepts all the content of it without limitations and obliges to adhere to it in all aspects. The client confirms specifically: a. That he has studied in detail and agrees to the general terms and conditions, specifically about our responsibility. b. That the agreement for services with us is entered into in its own benefit only. All our tours are approximately three to eight hours in duration from check-in time to the time you get back to the launch site. Note: This can vary depending on sea and weather conditions.2.How many kayakers will be on each tour? Small group up to 18 kayakers on each tour. In order to operate, all tours are subject to minimum number of kayakers, see specific tour info for details.3.What kind of people go out on your kayak tours? FUN people! If you’re not FUN, better keep Googling. This may not the tours for you!4.Is there an age limit? In order to paddle children must be 13 years old. Children 12 years of age & under must enjoy this experience in one of our awesome tandem kayaks accompanied by an adult. Minimum age to join our tours is 8 years old.5.Do I need any previous experience?No, you don't! Our kayaks are easy to use and incredibly stable. Our experienced guides will give you step-by-step instructions on how to paddle and what to do. You'll quickly find why kayaking is our favorite way to experience waters around Pula and south Istria.6.But don’t I need to be a good swimmer?Well it sure can’t hurt, but it’s not required. It's recommended that you do have some comfort and experience when you're in the water.7.How fast do we paddle? We do all our kayak tours at relaxing and slow pace.8.How far do we kayak?On our tours we paddle from three to six miles or less and are about 1.5 - 3 hours on the water. 9.Do tours require a high level of physical fitness?No, our tours are not designed to make you an pro kayaker. We do on occasion encounter strong winds that will require a higher level of exertion. We certainly try to avoid these situations when possible. Guides are prepared with all safety equipment and tow ropes if any situation proves to be too difficult for a paddler.10.Do we need a reservation? Kayak tours do sell out quickly and passenger seats are limited, so to guarantee your spot(s) we recommend that you make reservation in advance. Book on-line or Call ahead.11.How do we book a tour? Booking a tour is simple! For advance booking send us a request using our Booking form or Email and we'll get back to you within 24 hours. As we don't accept cards your cash payment is more than welcome.13.Are private kayak tours available? Yes, we often run private tours for groups up to 50 people looking for a unique way to spend quality time with friends or family. To inquire about booking a private tour, please send us an Email.14.Where is the meeting point for the kayaking tours?The meeting point depends on the chosen tour. You'll get an email with the Google maps location and the best way to get there.15.Is there parking available? Yes, on every meeting point there is plenty of unrestricted free parking and payment parking as well.16.How early we must arrive prior to departure? 20 minutes will give us plenty of time to get you checked-in and get you ready for departure. 17.What if we arrive late? Can you wait for us? If the other kayakers are ready, we have to respect their time and cannot delay their departure more than 5 minutes. If you're running late, you can try to contact the crew at +385 977 636 590. Depending on the circumstances we may be able to wait for you.18.Are there restrooms at the launch site? Yes, we strongly recommend that you use the land base facilities near the launch site prior to getting on the kayak. You will have access to clean toilet facilities before departure.19.What language do you speak on the tours? The tours are conducted in English. Don't worry, if English is not your first language, your guide is very expressive. 20.How should we prepare ourselves and what should we bring? Bring swimsuit, sun hat, sunscreen, beach towel, water shoes and positive vibe! The rest we'll take care for you.21.What equipment do you provide?We'll provide everything you'll need to have a fantastic experience. This includes: easy to use kayaks, paddles, inflatable vests, dry bags, drinks, seasonal fruits, and a fun, knowledgeable guides.22.What type of kayaks do you use? We primarily use tandem kayaks on our tours due to their stability. On most tours guests share a tandem kayak however a limited number of singles are available upon request.23.Can we stow anything on the kayaks? Yes, we provide a dry containers for your personal belongings, but there is a limited amount of room, so please only bring what you need. You can leave your back packs in our car for safe keeping.24.Are there food and drinks available on the tours? Yes, we offer refreshing drinks and seasonal fruits on all of our tours, on full day tours we'll serve a tasty lunch. (grilled fish, meat or veggie meal)25.Can we bring our own food? You're free to bring anything you would like to eat or drink as long as the amount is small and personal.26.Do we get to drink beer during the kayak tour?We do not allow alcoholic beverages on the tour. We have a priority to keep you safe on our tours and alcohol can take away from the paddling experience. Instead, save the drinking for after the tour.27.Will we get seasick? Not likely. We stay very close to the coast and in the summer months the sea is usually very calm. However, kayaks are in motion most of the time. The last thing we want is for anyone to get sick so if the weather is too rough, we'll have to postpone the tour. 28.Can I bring my camera on my snorkeling tour?Yes, you can bring your camera. But we would recommend you to bring waterproof one, so it won't get ruined easily.29.Do you offer photos from the kayaking tour?Our guides normally have a GoPro camera and can take photos during the tour. If you're interested in photos please give us your email and we'll send you download link the day after the tour. Kindly note that photos cannot be guaranteed. Our customers safety and wellbeing is our first priority, and therefore it can happen that the guide have to focus on helping the kayakers in the water instead of taking photos.30.Where we can download the tour photos taken by guides? You will get an email, with the link to our on-line gallery and log-in credentials needed to access the tour photos not later than 48 hours after the tour.31.What is your season, when do you run your tours? Our season starts in May and runs through October. During the off-peak, we are subject to passenger demand and sea conditions. During the peak (July & August) we run up to 3 tours a day.32.Do you have a weather cancellation policy? Activity may be canceled due to severe weather. The activity usually runs in light rain and other moderate weather conditions. We may cancel the activity up to an hour before the start time in the event of severe or unsafe weather conditions. If we cancel the activity, you'll be allowed to reschedule the tour (subject to availability). If rescheduling isn't possible, you'll be refunded.33.What is your cancellation policy? If you do not show up for your kayak tour, you forfeit your money and there are no refunds. Within 48 hours of the tour departure time, no refund is available. If you call up to 48 hours in advance and need to cancel or move your tour, we'll do our best to reschedule your tour date and time. If we're unable to find an appropriate date and time for you, 90% will be refunded. If the minimum number of kayakers (which is 4) are not registered, the tour it could be canceled.
