ABOUT OUR SERVICES How we help businesses claim what they're owed The IRS requirements are straightforward, getting the information required can be tough – We solve that problem: There is a lot of information circulating about the Employee Retention Credit – with much of it being half-truths designed to bait unsuspecting business owners into doing illegitimate business that does not benefit them. We’ll cut through the noise: There are only two ways to qualify: 1. Reduction in gross receipts (comparing 2020 revenue to 2019, and 2021 to 2020) 2. Your business must have been impacted by a government order (to a certain extent). A “Full or Partial Suspension of Operations” is where most of the confusion is occurring. If your business experienced pandemic-related impact, you may qualify as “partially suspended”. This impact often manifests as staffing shortages, supply chain issues, commercial disruptions, etc. These conditions and any other disruption to your business must be the result of a government order AND meet a clearly defined threshold of impact (established by the IRS) against your business for the quarter(s) the ERC is being claimed for. Example: Joe’s HVAC couldn’t get supplies in due to its supplier’s operations being restricted by government order EO-1X-49 which reduced its staffing, which reduced its ability to produce parts, which forced Joe’s HVAC to procure more expensive parts elsewhere, which increased Joe’s HVAC’s cost of doing business, which increased their gross receipts to the point they would not qualify for the ERC by revenue reduction alone – despite the losses sustained. Does Joe’s HVAC qualify? If Joe’s HVAC’s operations meet the specific impact threshold resulting from the government order that impacted their supplier, they can qualify for the quarters in which the impact can be traced to the government order. Our team will conduct an analysis to determine how your business can COMPLIANTLY claim the ERC Credit. Steps we take to ensure your ERC calculation is accurate Each ERC claim is calculated by 3 licensed, US-based CPAs working separately. Each CPA’s final calculation must match the others for the claim to proceed. Each CPA is an expert in the ERC tax code and has calculated thousands of ERC claims. If all 3 final results don’t match, the calculation process is restarted and an audit is performed to determine the root cause of the disparity. Is all liability on you if something goes wrong? Each agreement contains a “reimbursement clause” that governs any instance of errors/omissions by our firm. That being said, our firm assumes the responsibility of providing accurate calculations based on the data you provide. It is the responsibility of the business owner to ensure that their tax records are in order, and accurate documentation is submitted. There is a shared responsibility. Do our CPAs sign and prepare your ERC tax forms? Yes! Most ERC companies will compute the ERC calculations, and may even prepare the paperwork – however they require the business owner to sign the final tax forms. This unfairly places the liability for the preparer’s work on the business owner. Our licensed CPAs handle the preparation and signing of your ERC tax forms from start to finish. This means that if the IRS has an issue, our CPAs are listed as the preparer, not you. Do we outsource your claim overseas? No! Why is this relevant you might ask? While this is standard practice with smaller ERC firms, due to the volume we process it is imperative that our US-based CPAs have full control over the filing process from start to finish to ensure accuracy. Exporting your claim to another country, hoping the work is done correctly, and then having our CPAs sign off is too great a risk to both your business and ours. What is the benefit of using our ERC services vs a traditional CPA? We are a 100% US-based operation with physical locations around the country. We partner with a global consulting firm to provide independent third-party analysis on claims that DO qualify for the ERC but require professional assistance assembling the data and paperwork necessary to substantiate that claim. It’s not enough to know you qualify for the ERC or to believe that your pandemic impact is covered, the necessary documentation must be provided for our CPAs to sign the tax paperwork. Our consulting firm partner will conduct the analysis necessary to determine whether or not the “facts and circumstances” support the claim per IRS requirements, and guide the business owner through the paperwork process. This is in addition to the three-fold CPA calculation process and internal legal review that every claim undergoes. Our goal is not to maximize your ERC credit, our goal is to maximize the research conducted on your business’s situation to ensure that you receive the funds to which you are entitled. Do we require your ERC check to be deposited into our account like other ERC providers? No. We utilize the IRS’ Lockbox service which is administered by the Bureau of the Fiscal Service. When the IRS disburses your ERC funds, the IRS Lockbox will be responsible for distributing your funds to you, and our fee to us. EMPLOYEE RETENTION CREDIT RESOURCE CENTER What is the origin of the Employee Retention Credit? Initially established by the CARES Act, The American Rescue Plan Act of 2021 expanded eligibility for the Employee Retention Credit (ERC Credit). Thanks to this expansion, over 80% of previously ineligible businesses can now claim this payroll tax rebate. This includes businesses that received a PPP loan. Unlike the PPP, this is not a loan. You’ll receive a US Treasury-issued check that requires no repayment. Does the ERC have to be repaid? Is it a loan? The Employee Retention Credit is a tax refund, not a loan. It does not require repayment. How much money will I receive? The ERC program is a refundable tax rebate for business owners in 2020 and 2021. In 2020, a credit is available for up to $5,000 per employee from 3/12/20-12/31/20 by an eligible employer. That is a potential of up to $5,000 per employee. In 2021 the ERC increased to $7,000 paid per employee per quarter for Q1, Q2, and Q3. That is a potential of up to $26,000 per employee – paid directly to you from the IRS. I received a PPP loan, how will this impact me? Receipt of a PPP loan does not make you ineligible. The CAREs act was recently amended to allow business owners that claimed the PPP to claim the ERC as well. The amount you received through the payroll protection program will be deducted from your ERC rebate. Even with this deduction, on average the ERC is 1.6x your PPP loan. That means if you received $100,000 in PPP funds, you may receive $160,000 in ERC funds. Didn’t this program expire? Yes. However, you are still able to retroactively amend your quarterly tax returns to claim the credits you qualify for up to 3 years after the expiration date. The #1 reason the IRS audits will most likely be due to incorrect ERC calculations. Unlike most ERC processors, we do not outsource any part of your claim to India, Pakistan, or any other country for that matter. All of our ERC claims are processed by licensed, 100% US-based CPAs, and undergo a strict approval process by our team of Tax Attorneys. Each claim is sent to 3 CPAs who will manually calculate your ERC. The calculation from each CPA must match before the claim moves forwards to legal review. This is how we ensure it is correct. Why is this important? We’re hearing many stories of CPAs overseas filing fraudulent paperwork to extract quick “fee” money from unsuspecting business owners. When the IRS reviews these inflated filings, there will be no way for the business owner to locate the fly-by-night operation they allowed to file their paperwork, and they’ll be on their own to face the IRS. In the unlikely event of an IRS examination or audit, our firm will fully cooperate with your business, providing supporting documentation and analysis to support your claim. Our firm will reimburse your business for all costs incurred for such examination or audit to the extent the examination or audit is initiated due to errors or omissions on the part of our firm. In the event post-audit penalties, fees and/or fines are imposed by the IRS due to errors or omissions on the part of our firm, or the licensed professionals retained by our firm to secure the employee retention tax credit (ERC), the appropriate insurance policy claimant steps will be taken. Can my CPA do this? The calculations portion of the ERC is incredibly labor-intensive. CPAs are incredibly smart, but often underpaid and overworked. It just isn’t worth their time to spend days learning volumes of new tax codes for a single task. In fact, we provide fulfillment services for many accounting firms for this very reason. The other issue is that portions of the ERC are outside of the standard accounting wheelhouse. Qualifying for the ERC when a reduction in revenue did not occur is a research task requiring one to not only have knowledge of every pandemic-related government order issued in the country but also an understanding of how and if these orders were responsible for negatively impacting your business. For example, we work with many car dealerships that experienced significant increases in revenue during the pandemic.
