OUR TEAM


Our professionals have specialized studies in competition and intellectual
property law. In addition, members of our team have served as officers at the
Peruvian competition and intellectual property agency, the telecommunications
regulatory agency (OSIPTEL), the United Nations Conference on Trade and
Development (UNCTAD), the World Bank (WB), the World Intellectual Property
Organization (WIPO) and the Andean Court of Justice. We are actively involved in
providing legal opinions to national and international corporations, as well as
governmental and non-governmental organizations. We also are actively involved
litigating in the most important antitrust (including leniency and compliance
programs), unfair competition, bureaucratic barriers, dumping and subsidies
cases in Peru and the Andean Community. Our practice also involves regulatory,
advertising and marketing law, consumer protection, data privacy and life
sciences. Finally, we have a strong practice in all fields of Intellectual
Property law. At the academic level, our team have not only strong academic
credentials, which include Master´s degrees in Peru, the United States and
Europe, and are professors and lectures at Peruvian most prestigious
universities such as the Pontificia Universidad Católica del Perú (PUCP), the
Universidad Nacional de San Marcos (UNMSM) and the Universidad del Pacífico
(UP).

Luis Diez Canseco Núñez

Master of Laws Degree in Comparative Law awarded by the George Washington
University Law School. Has been a Fulbright and Hubert H. Humphrey Scholarship.
Dean of the Law School of the Universidad Tecnológica del Perú (UTP). Professor
at the PUCP, the Universidad Nacional Mayor de San Marcos (UNMSM), the
Universidad del Pacífico (UP) and the Universidad Peruana de Ciencias Aplicadas
(UPC), Graduate and Law Schools. Until 2016 served as Judge and later President
of the Andean Court of Justice, was International Officer at the World
Intellectual Property Organization (WIPO), the United Nations Conference for
Trade and Development (UNCTAD). Also was General Coordinator in the Program for
the Promotion of Competitiveness of the World Bank at the Office of the Peruvian
Prime Minister, Member of the Competition Tribunal (INDECOPI) and Member of
Collegiate Body of the Peruvian telecommunications agency. He was Partner and
Head of the Competition Law, Consumer Protection and Data Privacy Department in
Muñiz,Law Firm as well as associate lawyer at Alayza Consultores and Estudio

Master´s studies in Public Utilities, Regulation and Infrastructure Management
from the Universidad del Pacífico (UP). Professor at the UP Graduate School.
Professor at the Universidad Nacional Mayor de San Marcos (UNMSM) and the
Universidad Científica del Sur law schools. He was Legal Coordinator at the
Competition Tribunal (INDECOPI) and Senior Lawyer at the Dumping and Subsidies
Commission (INDECOPI). He also was Senior Associate of the Competition Law,
Consumer Protection and Data Privacy Department in Muñiz Law Firm, and worked at
Priori & Carrillo Abogados and the Regulation Area of Telefónica Móviles. He
awarded with a internship program at the Brazilian competition agency, the
Administrative Council for Economic Defense (CADE)

Castilla La Mancha, Spain, and a Master Degree in Regulation and Public
Utilities awarded by the PUCP. Professor at the Universidad del Pacífico (UP)
Graduate School, and at the PUCP and the Universidad Nacional Mayor de San
Marcos (UNMSM) law school. He was a Senior Lawyer at the Competition Tribunal
(INDECOPI), Legal Analyst at the Consumer Protection Tribunal (INDECOPI) and
worded at the Collegiate Body of the Peruvian telecommunications agency
(OSIPTEL). He was Associate Lawyer of the Competition Law, Consumer Protection
and Data Privacy department at Muñiz Law Firm.


Daniel Schmerler Vainstein

DANIEL SCHMERLER VAINSTEIN

Lawyer by Pontificia Universidad Católica del Perú, with master degree studies
ended in Intellectual Property and Competition Law. Certificated as Director,
with dual degree issued by High Direction Program of Universidad de Piura (Perú)
and IESE Business School (New York, USA). Studied to the Harvard Environmental
Energy Program (HEEP) that was held in Cambridge, Massachusetts – USA in the
classrooms of Harvard Kennedy School, sponsored by Harvard University. Member
and President of the Administrative Bankruptcy Court in INDECOPI, the Peruvian
competition agency. Also President of the Full Courtroom of that court. Before
that, he was member of the Insolvency Procedures Commission. He is member of
INSOL (International association of specialized professionals in turnaround and
insolvency). He was Chairman of the Board of Directors of OSINERGMIN (the
Peruvian energy regulatory agency), and Member of the Collegiate Bodies of
OSIPTEL (the Peruvian telecom regulatory agency). He has been Chairman of the
International Confederation of Energy Regulators – ICER, and, before of that,
was Chairman of the Iberoamerican Energy Regulators Association – ARIAE. Also he
has been a Consultant for the Organization of American States. He has been
university professor in Pontificia Universidad Católica del Perú and Universidad
del Pacífico, an also speaker in important events in America, Africa, Asia and
Europe.


Tommy Deza Sandoval

Lawyer from the Universidad Nacional Mayor de San Marcos (UNMSM). Holds a Master
in Regulation of Public Network Services degree from the Universitat de
Barcelona. Graduated from the Specialization Course in Telecommunications
Regulation from OSIPTEL, as well as the Specialization Course in Energy
Regulation from OSINERGMIN. He has 17 years of experience in the public sector
in Administrative Law and Public Management. Hold senior management positions at
the Social Security of Health (EsSalud), the Ministry for Development and Social
Inclusion ((MIDIS); the Ministry of Economy and Finance (MEF): and the Ministry
for Justice and Human Rights (MINJUS). He was also member of the Commission of
Infringements and Sanctions of the Peruvian Agency for International
Cooperation. Regarding his specialization in Administrative Law and officer at
MINJUS, he was member of the Working Group responsible for drafting the
Amendments of the General Administrative Procedure Law and responsible for
elaborating its first Single Ordained Text. Was also member of the first
Multisectoral Commission for Regulatory Quality which, in application of the Law
for Administrative Simplification, was in charge of reviewing the regulatory
stock of administrative procedures of the Executive branch. Within his academic
activities, he is professor of Administrative Law and Regulatory Impact Analysis
at the UNMSM; the Pontificia Universidad Católica del Perú; the Postgraduate
School of the Universidad Peruana de Ciencias Aplicadas; the School of Public
Management of the Universidad del Pacífico; and the Academia Nacional de la
Magistratura.


Omar Alvarado Escobar

Mr. Alvarado holds a law degree from the Pontificia Universidad Catolica del
Peru (PUCP) and a Master of Science in Regulation from the London School of
Economics and Political Science (LSE). He also took postgraduate studies in
Competition and Regulation at Universidad de Valladolid and Mergers,
Acquisitions and Merger Control Law at Universidad de Lima, as well as
participated in the course regarding public transportation infrastructure
provided by the Peruvian regulatory agency (OSITRAN). He was Senior Associate in
the department of Competition, Regulation and Intellectual Property from Miranda
& Amado Abogados (from 2013 to 2022) and served in the Competition Chamber of
INDECOPI as Legal Coordinator (from 2008 to 2013). He was international
associate at Gomez-Pinzon Abogados, a Colombian law firm based in Bogota (2017),
focusing his practice on intellectual property, competition, and data privacy
matters. In the academic field he has been teaching assistant in Competition Law
(Competencia 1), Unfair Competition and Advertising (Competencia 2), and
Commercial Law practical course (Seminario de Integracion en Derecho Mercantil)
at Pontificia Universidad Catolica del Peru (PUCP).


Danny Alcarraz Serna

DANNY ALCARRAZ SERNA

Lawyer Degree by the Universidad Nacional Mayor de San Marcos. Has Master´s
studies in Regulation from the Universidad Peruana de Ciencias Aplicadas (UPC).
Also has completed postgraduated study programmes such as Public Private
Partnerships in Public Utilities (UPC), Energy Law (PUCP) and Enviromental Law
(UPC). Likewise, has taken different courses as Compliance and Competition
Policy (Pontificia Universidad Católica de Chile), Competition Policy Tools
(Pontificia Universidad Católica del Perú), Infrastructure Regulation (OSITRAN),
Energy Law (OSINERGMIN) and Telecommunications Law (OSIPTEL). He has served as
Technical Secretary of the Dispute Resolution and Competition Appeal Court at
OSIPTEL and Senior Lawyer focused on antitrust, dumping, fair competition and
consumer protection in different areas at INDECOPI. Previously, he was former
Associate Attorney at Payet Rey Cauvi Law Firm and Legal Counsel at Tariffs
Regulation Department of OSINERGMIN.


Carlos Beraún Mac Long

in Comparative Law, Economics and Finance at International University College of
Turin (IUC), Italy. Postgraduate Diploma in Regulation and Competition from the
University of Valladolid, Spain. Candidate for the Master's Degree in
Intellectual Property and Competition Law at the Pontifical Catholic University
of Peru. He has several postgraduate courses in Antitrust, organized by the
Ceddet Foundation and the National Commission of Markets and Competition (CNMC)
of Spain, as well as in the workshop “The Challenges of Regulation” organized by
the University of the Pacifico and lectured by Robert Baldwin, from the London
School of Economics & Political Science (LSE). He has been professor in Consumer
Protection and Regulation of Public Utilities at the Faculty of Law of the
University of San Martín de Porres. He has spent a large part of his career at
the Peruvian Competition Agency (Indecopi) as Specialist and Executive at the
Competition Chamber; Analyst in both the Consumer Protection Commission and the
Chamber in Consumer Protection; and recently as a Legal Counsel in the National
Direction of Investigation and Promotion of Competition, in the merger control
division). Regarding his experience in private sector, he has been a Senior
Associate at Diez Canseco Competition and IP and at Lazo & De Romaña, sponsoring
administrative proceedings in competition matters as well as implementing
regulatory compliance programs in antitrust, advertising, unfair competition and
consumer law. His areas of expertise are Antitrust Law, Unfair Competition Law,
Consumer Law, Dumping and Subsidies, Compliance Programs in Antitrust and
Consumer Law.

of Estudio Olaechea. Teaching assistant in Administrative Law and Competition
Law at the Faculty of Law of PUCP as well as in the Unfair Competition and
Advertising Law course of the Masters Program in Intellectual Property the
Competition of PUCP. He has been a member of the Themis Civil Association
(Magazine of Law of the Pontificia Universidad Católica del Peru).

Competition Law and Consumer Protection. Has been an Associate in the
Intellectual Property and Competition Law Area of Casahierro Abogados. Has
worked at the Technical Secretariat of the Specialized Chamber for Defense of
Competition of the INDECOPI, Peruvian Institute for the Defense of Competition
and the Protection of Intellectual Property (INDECOPI); thus having experience
in both the public and private sectors. Has been a member of the Board of
Directors of the Association ADV Editores.

the Patent Cooperation Treaty (PCT) training program organized by the Instituto
Nacional de la Propiedad Industrial (INAPI), Santiago de Chile. Has taken
courses of Intellectual Property Management, the UPOV System for the Protection
of Plan Varieties, as well as Patents organized by the World Intellectual
Property Organization (WIPO). Worked at the Special Chamber for Intellectual
Property of the Peruvian Institute for the Defense of Competition and the
Protection of Intellectual Property (INDECOPI) as well as in the Inventions and

Pharmaceutical Law by the Universidad Peruana Cayetano Heredia (UPCH). Obtained
the International Certificate for Medicine Evaluation Dossiers by the UNMSM.
Worked at the Peruvian pharmaceutical administration, the Dirección General de
Medicamentos, Insumos y Drogas (DIGEMID). Has worked at the regulatory area for
AC FARMA Laboratories, as well as in companies such as Food Solutions Group and
Droguería La Victoria. Her specialization areas are sanitary regulation of
pharmaceutical establishments and pharmaceutical products, medical devices,
cosmetics, sanitary products, foods and beverages.
