This Privacy Policy (“Policy”) explains how we collect and use visitors’ and customers’ Personal Data as part of the Service, and also sets out the separate rights that you may have in relation to Personal Data. Any discussion of your use of the Service in this Policy is meant to include your visits and other interactions with the Chainalysis Website and our other web-based services. When we use the words “you”, “your” or “yours”, we mean a website visitor or customer of our web-based services, and when we use the words “we”, “us” or “our”, we are referring to Chainalysis and its affiliates. We may choose or be required by law to provide different or additional disclosures relating to the processing of Personal Data about residents of certain countries, regions, or states, such as the European Economic Area (EEA) or the State of California. Where we provide jurisdiction-specific disclosures in this Policy, we will identify the jurisdiction to which they apply. Please note that references in this Policy to the EU General Data Protection Regulation (GDPR) are aimed at EEA citizens only, and references to the United Kingdom (UK) GDPR are aimed at UK citizens only. For the avoidance of doubt, either GDPR does not apply if you are based elsewhere in the world. We recommend that you periodically read this Policy in full to ensure you are fully informed about our collection, processing and sharing of your Personal Data. This Policy is not a contract and does not create any legal rights or obligations not otherwise provided by applicable law. QUICK LINKS We recommend that you read this Privacy Notice in full to ensure you are fully informed. However, if you are looking for access to specific sections, then you can click on the relevant link below to jump to that section. * Who we are * Responsible Chainalysis Entity * What Do We Mean by “Personal Data”? * How Do We Collect, Use and Share Personal Data? * Who Do We Share Your Personal Data With? * Data Retention * Your Rights * Changes to this Privacy Policy * How to Contact Us WHO WE ARE The Chainalysis Website is operated by Chainalysis Inc. (“Chainalysis”) with a mailing address of 228 Park Avenue South, #23474, New York, New York 10010. We are a blockchain analysis company providing blockchain analytics, compliance, and investigation offerings to banks, businesses, and governments. This Policy sets out how we collect, use, disclose, and otherwise process Personal Data from you or about you. RESPONSIBLE CHAINALYSIS ENTITY Data privacy laws sometimes differentiate between “controllers” and “processors” of personal information. A “controller” determines the purposes and means (i.e., the why and how) of processing personal information. Chainalysis is the controller of Personal Data (defined below) as described in this Policy unless otherwise noted. This Policy does not generally apply to the company’s processing activities in its capacity as a processor or service provider. As Chainalysis is based in the U.S, Chainalysis Inc. has appointed a UK and an EU representative under Article 27 of the GDPR, as follows: * EU Representative: Chainalysis ApS, which is based in Denmark * UK Representative: Chainalysis LTD, which is based in the United Kingdom. How to opt-out of online behavioral advertising Certain of our third-party providers may directly collect Personal Data about your activities over time and across different websites and applications when you use our Services for purposes of providing behavioral or interest-based advertising services to third parties. We support the self-regulatory principles for online behavioral advertising published by the Digital Advertising Alliance. These principles allow individuals to exercise choice regarding the collection of information about online activities over time and across third-party websites and applications for online interest-based advertising purposes. More information about these principles can be found at www.aboutads.info. If you want to opt-out of receiving online interest-based advertisements on your internet browser from advertisers and third parties that participate in the Digital Advertising Alliance program and perform advertising-related services for us and our partners, please follow the instructions at www.aboutads.info/choices, or http://www.networkadvertising.org/choices/ to place an opt-out cookie on your device indicating that you do not want to receive interest-based advertisements. Opt-out cookies only work on the internet browser and device they are downloaded onto. If you want to opt out of interest-based advertisements across all your browsers and devices, you will need to opt-out on each browser on each device actively used. If you delete cookies on a device generally, you will need to opt-out again. To opt-out of receiving online interest-based advertisements on mobile apps, please follow the instructions at http://www.aboutads.info/appchoices. Please note that when you opt-out of receiving interest-based advertisements, this does not mean you will no longer see advertisements from us or on our Services. DATA TRANSFERS FROM THE EUROPEAN ECONOMIC AREA AND THE UK Some of the third parties with whom we share Personal Data may be based outside the European Economic Area or the UK. Chainalysis only transfers Personal Data to countries outside the UK and EEA if that country has an adequate level of protection according to the EU or EU Commission or the UK Government, if this is specifically done on the basis of your consent when you provide your Personal Data to us, or where we rely on a mechanism for protecting your Personal Data as provided for in the UK and EU GDPR. For example, we may rely on the standard contractual clauses published by the European Commission and similar measures under UK laws when we share your Personal Data within the different Chainalysis group entities. EU-U.S. AND SWISS-U.S. PRIVACY SHIELD As of July 16, 2020, we no longer rely on the Privacy Shield as an adequacy mechanism to address European data protection requirements regarding the transfer of personal data to the U.S. However, Chainalysis continues to comply with the relevant Privacy Shield Principles for the personal data it previously received from the European Union, United Kingdom, and Switzerland in reliance on the Privacy Shield. The rights a UK and an EEA citizen has (which will apply to Chainalysis customers and users based in the UK and the EEA) are described below. These rights do not apply to non-UK and non-EEA citizens and do not apply to anonymized or non-Personal Data. * Right of access: The right to be provided with a copy of your Personal Data * Right to rectification: The right to require us to change or modify the Personal Data that you think is inaccurate * Right to erasure (also known as the right to be forgotten): The right to require us to delete your Personal Data—some exceptions may apply * Right to restriction of processing: The right to require us to restrict processing of your Personal Data—in certain circumstances, e.g. if you contest the accuracy of the data * Right to data portability: The right to receive the Personal Data you provided to us, in a structured, commonly used and machine-readable format and/or transmit that data to a third party in certain situations * Right to object: The right to object at any time to your Personal Data being processed for direct marketing (including profiling); and in certain other situations to our continued processing of your Personal Data, e.g. processing carried out for the purpose of our legitimate interests. * Right to not be subject to automated decision making: The right not to be subject to a decision based solely on automated processing (including profiling) without any human intervention that produces legal effects concerning you or similarly significantly affects you If you are an individual based in the UK or the EEA and you would like to exercise any of these rights described above, please write to us using the contact details below under the Section ‘Contact us’, giving us enough information in order to identify you and providing us with proof of your identity and address, letting us know what right you want to exercise and the information to which your request relates. Under the UK and the EU GDPR, we are required to respond to you within 30 days unless the request is complex or onerous. We will respond to you within this timeline, either to let you know that we have complied with the request, to ask for further information or an extension of time if this is required, or to explain why we feel we are not able to comply with the request. If you do not agree with our decision, you can make a complaint as outlined directly below. We hope that we can resolve any query or concern you may raise about our use of your Personal Data, so please do contact us or our UK or EU Representative (as applicable) in the first instance. However, if we are unable to resolve your query to your satisfaction, the UK and the EU GDPR gives both the UK and EEA citizens a right to lodge a complaint with a supervisory authority. * For UK citizens, this will be to the Information Commissioner’s Office, which is also known as the ICO. You can contact the ICO via this link: https://ico.org.uk/global/contact-us/. * If you are an EEA citizen, this will be the supervisory authority in the member state where you work, normally live, or where any alleged infringement of data protection laws has occurred. A list of EEA supervisory authorities is available via this link: https://edpb.europa.eu/about-edpb/about-edpb/members_en. * The supervisory authority in Denmark, which is our lead authority, is the Datatilsynet, and they can be contacted by phone on +45 33 19 32 00, by email to dt@remove-this.datatilsynet.dk, or by post at Datatilsynet, Carl Jacobsons Vej 35, DK-2500 Valby, Denmark. Although we try to limit the Personal Information collected in connection with a request to exercise the right to know and/or right to deletion to that Personal Information identified in our online form, certain requests may require us to obtain additional Personal Information from you. In certain circumstances, we may decline a request to exercise the right to know and/or right to deletion, particularly where we are unable to verify your identity. Although we have not sold Personal Information in the last 12 months, we may in the future engage in data transfers that constitute a sale under California law. To exercise your right to opt out of Personal Information sales, click the following link to complete our online form or call us at (888) 876-4875. Do Not Sell My Personal Information You do not need to create an account with us to exercise your right to opt out of Personal Information sales. However, we may ask you to provide additional Personal Information so that we can properly identify you in our dataset and to track compliance with your opt out request. We will only use Personal Information provided in an opt out request to review and comply with the request. If you choose not to provide this information, we may only be able to process your request to the extent we are able to identify you in our data systems. Once you make an opt-out request, you may change your mind and opt back in to future Personal Information sales at any time by contacting us at privacy@chainalysis.com. In certain circumstances, you are permitted to use an authorized agent to submit requests on your behalf through the designated methods set forth above where we can verify the authorized agent’s authority to act on your behalf as follows. For requests to know or delete Personal Information * Receiving a power of attorney valid under the laws of California from you or your authorized agent; or * Receiving sufficient evidence to show that you have: * (1) Provided the authorized agent signed permission to act on your behalf; * (2) Verified your own identity directly with us pursuant to the instructions set forth in these Disclosures; and * (3) Directly confirmed with us that you provided the authorized agent permission to submit the request on your behalf. For requests to opt-out of Personal Information sales * Receiving a signed permission demonstrating your authorized agent has been authorized by you to act on your behalf. We may deny a request in the event we are not able to verify the authorized agent’s authority to act on your behalf. Free Trials For prospective customers who choose to provide us with their contact information, we offer a free trial to our paid Services. Prospective customers providing us with their contact information including their email address are able to take advantage of the free trial and will be automatically signed up to receive updates from Chainalysis. We have determined in good faith that the value of the personal information we receive from you and the relationship we establish is reasonably related to the value of the free offerings we provide. You can request to opt in to our free trial by attending one of our training sessions and providing us your contact information in connection with the offer. You may withdraw from our free trial at any time by contacting our sales team at support@chainalysis.com. How do I withdraw my consent for handling my Personal Data? To do this, please contact us using the contact details below under the Section ‘Contact Us’, giving us enough information in order to identify you and providing us with proof of your identity and address, letting us know what Personal Data you would like to be deleted. We will let you know if we can comply with this request, and the applicable time frame for doing so. CHANGES TO THIS PRIVACY POLICY This Privacy Policy was updated on March 3, 2022.
