FINDING JUSTICE AT THE INTERNATIONAL CRIMINAL COURT

The International Criminal Court is the world’s only permanent, independent
court established to prosecute individuals for genocide, war crimes, crimes
against humanity, and crimes of aggression.

The ICC is a legacy of the international Nuremberg trials held after World War
II by England, France, the Soviet Union and the United States, and has been
operating since 2002 in The Hague, Netherlands. 

The court has rarely been more important or needed more robust support from the
United States than now. It is investigating crimes carried out by Russia in
Ukraine. Karim Khan, the chief prosecutor, has issued arrest warrants for
Vladimir Putin and his associate Maria Belova-Lvova on charges of war crimes for
abducting and deporting more than 16,000 Ukrainian children into Russian-held
territory.

I spent a week at United Nations headquarters in New York in December, along
with representatives from 124 countries and leaders of human rights
organizations from around the world. We were attending the 22nd annual Assembly
of States Parties of the International Criminal Court.

I am the founder and director of World Without Genocide, located at Mitchell
Hamline School of Law, and we have Special Consultative Status at the UN and are
a member of the global Coalition for the International Criminal Court, which
allowed us to attend this special meeting. 

Some background: The ICC is a so-called “a court of last resort,” to be used
when a state is either unable or unwilling to take on the cases in its domestic
courts. 

The court seeks to end impunity and deter future crimes by charging those who
have the greatest responsibility for mass atrocities. Since its inception, the
ICC has indicted more than 40 individuals, including Sudan’s former president
Omar Al-Bashir for genocide and crimes against humanity. There is no immunity
for heads of state. Situations are under investigation today in countries
including Sudan, Myanmar, Central African Republic, Georgia, Ukraine,
Afghanistan, Venezuela, Colombia, Kenya and Iraq.

The ICC has also opened investigations into possible war crimes committed in
both Palestine and Israel dating back to the Hamas-initiated war in 2014 through
today. Chief Prosecutor Khan has particularly addressed hostage-taking, a grave
violation of the Geneva Conventions, and he has called for the release of the
individuals held by Hamas. He has also reminded Israel of its “obligation to
comply with the laws of armed conflict,” stating that “impeding relief supplies
may constitute a crime.” 

At the assembly, the agenda included both administrative and policy issues,
including selecting new judges, establishing the budget, and enhancing security.
Of special significance, the Office of the Prosecutor announced expanded
procedures to address crimes against children— one in six worldwide live in
conflict zones — and crimes involving sexual, reproductive and other
gender-based violence.  

Since its inception, the court has also focused on providing financial
reparations to people and/or communities that have been harmed by perpetrators’
crimes. Where financially possible, the guilty persons pay reparations
themselves; if unable to do so, there is a Trust Fund for Victims, supported by
contributions from state parties. 

While participating nations debate and decide administrative issues, the
conference also includes nongovernmental organizations like Amnesty
International, Human Rights Watch and World Without Genocide, which meet to help
shape the court’s operations and bring forward important issues in human rights
and international criminal law. For example, UN Women held session on the effort
to create an international convention for Crimes against Humanity. 

Most of the world’s nations are parties to the court, but the U.S. is notable by
its absence — along with China, Russia, India and Israel. The U.S. has had an
on-again, off-again relationship with the court. U.S. legal scholars and
activists supported the court’s formation, and President Bill Clinton signed on
to ratify the Rome Statute, the first step in becoming a state party. However,
President George W. Bush ‘erased’ that signature and subsequently initiated the
American Service Members Protection Act of 2002, informally known as “The Hague
Invasion Act,” which threatened to withdraw military aid from countries that
supported the court.

Former President Donald Trump had an adversarial relationship with the court,
placing sanctions on then-Chief Prosecutor Fatou Bensouda and refusing to issue
visas for certain court personnel. In June 2020, a Trump executive order
declared a national emergency and authorized asset freezes and family entry bans
against ICC officials. In 2021, the Biden administration dropped these
sanctions. 

Since Russia’s invasion of Ukraine in February 2022, the U.S. stance towards the
court has been very positive. The U.S. is supporting with money and expert
assistance the ICC investigations in Ukraine of crimes dating to the 2014
invasion of Crimea.

I have attended the assembly sessions for several years, each time including
students from law schools in Minnesota and elsewhere from our World Without
Genocide delegation. We encourage lawyers and others to join us in advocating
for this court, as did the president of the American Bar Association in her
address to the assembly at the recent meeting. She said, “The ABA will continue
to support the ICC as a crucial forum for justice for atrocity crimes, and to
advance the rule of law and global practice of international criminal justice.”

Even as we mourn the atrocities we are seeing around the world, we must work to
support institutions like the ICC that will allow the international community
— including, crucially, the United States — to work toward a more just world for
all.
