House Bill 3361, by Rep. T.J. Marti, R-Broken Arrow, would require marijuana distributors to ship their product in packages of 3 ounces or less beginning June 1, 2025. Dropped from the version that passed through a House committee last week was a section that would have prohibited logos and packaging that "appeal to children." Marti has struggled to define that term and said Thursday that "we will continue to work on that in a Senate bill." Prepackaging is an issue for some in the medical marijuana business because, they say, it adds to the cost with no clear benefit for consumers. Prepackaging's most vocal critic, Rep. Mickey Dollens, D-Oklahoma City, said it benefits only the "prepackaging industry." He predicted that the packages will be opened and the contents combined in large containers by retailers for what is called deli-style display. Marti disagreed and said the complaints are from a relatively small number of dispensaries. "They say things like, 'My patients won't be able to smell the marijuana.' It's already illegal to do that," Marti said. "And that's the No. 1 complaint I've gotten about this bill." Other patient complaints center on the amount of plastic waste already created by the medical marijuana industry, which is likely to be exacerbated by prepackaging. For some the underlying issue may be product tracking and attempts to control what law enforcement says has been a large illegal marijuana market operating in the nooks and crannies of the state's medical marijuana landscape. HB 3361 passed 57-23, with 21 members not voting and seven Republicans in the opposition. The bill now goes to the Senate. Also Thursday: In another indication that criminal justice reform is running out of steam in the Legislature, the House voted down a measure that would have automatically expunged misdemeanor arrests after 10 years, provided the offender kept a clean record. HB 3729, by Rep. Jason Lowe, D-Oklahoma City, got only 35 of the 51 votes needed for passage and came as the Republican majority demonstrates a greater willingness to create more felonies and enforce longer sentences for certain crimes. The House did pass HB 3499, by Rep. Tammy West, R-Bethany, which would bar landlords who receive low-income housing tax credits from rejecting potential tenants based solely on a prior conviction. The bill would require an individualized assessment of each applicant and allow rejection if the person is judged a threat to the "health, safety and peaceful enjoyment" of the other residents. • The paper voter registration cards issued by county election boards would no longer be sufficient voter identification under legislation approved Thursday. HB 3717, by Rep. Terry O'Donnell, R-Catoosa, would require Service Oklahoma to provide photo IDs to registered voters who request them. Currently, the photoless voter registration cards or any government-issued photo identification is accepted. O'Donnell, though, said the photoless cards confuse poll workers and could make fraudulent voting, especially by illegal immigrants, easier to accomplish. No such cases of fraud have been reported in Oklahoma, and opponents of the measure said O'Donnell's admission that relatively few people use the voter registration card for identification indicates that it is not an issue. Instead, they maintained, the law would create a hardship for legitimate voters without easy access to Service Oklahoma. HB 3717 passed 71-17 along party lines. • HB 3854, by Rep. Rusty Cornwell, R-Vinita, which would provide up to $35 million in rebates to Vinita for water and sewer projects related to a proposed 320-acre RV park and campground, passed 69-17 with a strange-bedfellows mix of Republican and Democrat opposition. • Bucking and snorting by members suspecting a boondoggle did not prevent passage of HB 3749, by Rep. Jim Grego, R-Wilburton, which would set aside $8.3 million to renovate the Oklahoma State Penitentiary rodeo arena. Grego said restarting the once-popular event will generate income for the Department of Corrections and give inmates something to do. One of the 29 members voting against the deal, Rep.
