IS ATLANTA A NO-FAULT DIVORCE JURISDICTION?
Many states have adopted a “no-fault” system for divorce. Instead of requiring
divorcing couples to prove that there are valid reasons why the marriage has
failed, a no-fault state allows couples to dissolve their marriage regardless of
who might be to blame.
Georgia is a “no-fault” and a “fault” state, meaning that a person may simply
state that the marriage is irretrievably broken with no hope of reconciliation
and obtain a divorce. However, one may also file on “fault” grounds
establishing that one person was a “fault” for the breakup of the marriage.
Examples of common grounds for divorce in Atlanta include:
* Narcissism
* The marriage has become irretrievably broken
* Adultery
* Habitual intoxication
* Drug addiction
* Cruel treatment
* Mental incapacity that began prior to the marriage
* Abandonment
Some of these grounds are more commonly cited than others. In fact, most
